                     A BILL FOR AN ACT

PROPOSING THE REPEAL OF ARTICLE XIII OF THE HAWAII CONSTITUTION
   RELATING TO COLLECTIVE BARGAINING BY PRIVATE AND PUBLIC
   EMPLOYEES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  The purpose of this Act is to propose the repeal
 
 2 of Article XIII of the Constitution of the State of Hawaii to end
 
 3 collective bargaining and restore one's right to work in the
 
 4 private and public sectors.
 
 5      SECTION 2.  Article XIII of the Constitution of the State of
 
 6 Hawaii is repealed.
 
 7                          ["ARTICLE XIII
 
 8                ORGANIZATION; COLLECTIVE BARGAINING
 
 9                         PRIVATE EMPLOYEES
 
10      Section 1.  Persons in private employment shall have the
 
11 right to organize for the purpose of collective bargaining.
 
12      Section 2.  Persons in public employment shall have the
 
13 right to organize for the purpose of collective bargaining as
 
14 provided by law."]
 
15      SECTION 3.  The question to be presented on the ballot shall
 
16 be as follows:
 
17      "Shall the current constitutional provisions providing for
 
18 the right of collective bargaining in both private and public

 1 employment be repealed?"
 
 2      SECTION 4.  Constitutional material to be repealed is
 
 3 bracketed.
 
 4      SECTION 5.  This repeal shall take effect upon compliance
 
 5 with Article XVII, section 3, of the Constitution of the State of
 
 6 Hawaii.
