                     A BILL FOR AN ACT

RELATING TO MARTIN LUTHER KING DAY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  The purpose of this Act is to broaden the
 
 2 significance of Martin Luther King Day in Hawaii to commemorate
 
 3 and appreciate the civil rights of all Americans by observing the
 
 4 anniversary of Executive Order 9066 on January 19, 1942 which
 
 5 ordered the internment of 120,000 people of Japanese ancestry at
 
 6 the onset of World War II.
 
 7      Just as it is important to remember Dr. King's fight against
 
 8 the discrimination of African-Americans, the internment of
 
 9 Japanese Americans was also an ugly mark upon American history.
 
10 These events symbolized the importance and fragility of our civil
 
11 rights.  There is a common interest among all Americans,
 
12 regardless of race, color, or creed, to protect our rights and
 
13 liberties, and an annual observance would serve to educate and
 
14 remind us of this ongoing human struggle.
 
15      In Hawaii, Martin Luther King Day should be a day to
 
16 remember that civil liberties are dear to all Americans and must
 
17 be guarded and preserved by its citizens.
 
18      SECTION 2.  Section 8-1, Hawaii Revised Statutes, is amended
 
19 to read as follows:

 1      "§8-1  Holidays designated.  The following days of each year
 
 2 are set apart and established as state holidays:
 
 3      The first day in January, New Year's Day;
 
 4      The third Monday in January, Dr. Martin Luther King, Jr.
 
 5 (Civil Liberties) Day;
 
 6      The third Monday in February, Presidents' Day;
 
 7      The twenty-sixth day in March, Prince Jonah Kuhio
 
 8 Kalanianaole Day;
 
 9      The Friday preceding Easter Sunday, Good Friday;
 
10      The last Monday in May, Memorial Day;
 
11      The eleventh day in June, King Kamehameha I Day;
 
12      The fourth day in July, Independence Day;
 
13      The third Friday in August, Admission Day;
 
14      The first Monday in September, Labor Day;
 
15      The eleventh day in November, Veterans' Day;
 
16      The fourth Thursday in November, Thanksgiving Day;
 
17      The twenty-fifth day in December, Christmas Day;
 
18      All election days, except primary and special election days,
 
19 in the county wherein the election is held;
 
20      Any day designated by proclamation by the President of the
 
21 United States or by the governor as a holiday."
 
22      SECTION 3.  Statutory material to be repealed is bracketed.
