                   A  BILL  FOR  AN  ACT

RELATING TO HIGHWAYS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 286, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to part X to be appropriately designated
 
 3 and to read as follows:
 
 4      "§286-    Exception to liability for state and county
 
 5 employees pushing stalled motor vehicles off the highways.  Any
 
 6 state or county operator of a motor vehicle designed and equipped
 
 7 to move or push stalled motor vehicles off from highways who in
 
 8 the course of employment for a state or county agency with
 
 9 oversight over highway safety moves a stalled vehicle out of the
 
10 traffic lanes of a highway shall not be liable for civil damages
 
11 resulting from the operator's acts or omissions, except for such
 
12 damages as may result from the operator's gross negligence or
 
13 wanton acts or omissions."
 
14      SECTION 2.  New statutory material is underscored.
 
15      SECTION 3.  This Act shall take effect upon its approval.
