                   A  BILL  FOR  AN  ACT

RELATING TO THE DRIVERS EDUCATION FUND UNDERWRITERS FEE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 431:10C-115, Hawaii Revised Statutes, is
 
 2 amended as follows:
 
 3      1.  By amending subsection (a) to read:
 
 4      "(a)  The commissioner shall assess and levy upon each
 
 5 insurer, and self-insurer, a drivers education fund underwriters
 
 6 fee of [$2] $3 a year on each motor vehicle insured by each
 
 7 insurer or self-insurer.  This fee is due and payable on an
 
 8 annual basis by means and at a time to be determined by the
 
 9 commissioner."
 
10      2.  By amending subsection (c) to read:
 
11      "(c)  The commissioner shall allocate the fees deposited for
 
12 each fiscal year in the following manner:
 
13      (1)  [Fifty] Thirty-five per cent to the commissioner to be
 
14           expended for the operation of the drivers education
 
15           program provided in section [[]286-128(d)[]]; and
 
16      (2)  [Fifty] Sixty-five per cent to the director of commerce
 
17           and consumer affairs for:
 
18           (A)  The drivers education program administered by the
 
19                department of education for high school students;

 1                and
 
 2           (B)  The traffic safety education program established
 
 3                and administered by the department of education
 
 4                pursuant to section 302A-417."
 
 5      SECTION 2.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 3.  This Act shall take effect upon its approval.
