                   A  BILL  FOR  AN  ACT

RELATING TO METROPOLITAN PLANNING ORGANIZATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 279E-7, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§279E-7[]]  Functions of the Metropolitan Planning
 
 4 Organization.  The functions of each Metropolitan Planning
 
 5 Organization shall include:
 
 6      (1)  [Serve] Serving in an advisory capacity to the
 
 7           legislature, the legislative body of the county, and
 
 8           the appropriate state and county agencies in carrying
 
 9           out continuous, comprehensive, and cooperative
 
10           transportation planning and programming for the county
 
11           as required by federal laws and rules[.];
 
12      (2)  [Obtain] Obtaining information and plans from the
 
13           appropriate county and state agencies to formulate a
 
14           [short-range six-year transportation plan for the
 
15           county and an annual update of that plan, and a master
 
16           multi-modal] transportation improvement program and an
 
17           intermodal long-range transportation plan for the
 
18           county in order to advise the legislature, the
 
19           legislative body of the county, and other appropriate

 1           agencies regarding those plans[.];
 
 2      (3)  [Review] Reviewing the capital improvement programs of
 
 3           both the county and state for urbanized and rural areas
 
 4           of the county as they concern transportation[.];
 
 5      (4)  [Integrate] Integrating transportation planning for the
 
 6           county with a statewide transportation planning program
 
 7           authorized by Act 218, SLH 1974[.];
 
 8      (5)  [Develop] Developing recommendations to the state
 
 9           legislature and the legislative body of the county
 
10           regarding transportation policy matters[.];
 
11      (6)  [Act] Acting as liaison with the intermodal planning
 
12           group of the secretary of transportation[.];
 
13      (7)  [Coordinate] Coordinating the mathematical modeling
 
14           essential to the transportation planning process of the
 
15           county[.];
 
16      (8)  [Ensure] Ensuring a continuing, comprehensive
 
17           transportation planning process carried on
 
18           cooperatively by the State and the county[.];
 
19     [(9)  Develop a formula for the distribution of metropolitan
 
20           planning funds which shall consider but not necessarily
 
21           be limited to population, status of planning, and
 
22           metropolitan area transportation needs, and submit this

 1           formula for approval by the secretary of
 
 2           transportation.
 
 3     (10)  Receive and distribute, as necessary, federal funds
 
 4           under Section 112 of the Federal-Aid Highway Act of
 
 5           1973, the Urban Mass Transportation Act of 1964, as
 
 6           amended, Section 13 of the Airport and Airway
 
 7           Development Act of 1970, as amended, and Section 5 of
 
 8           the Urban Mass Transportation Act of 1964, as amended.
 
 9     (11)] (9)  Performing all activities necessary to comply with
 
10           federal laws and rules relating to metropolitan
 
11           planning organizations;
 
12     (10)  [Receive and distribute,] Receiving and distributing,
 
13           as necessary, such federal, state, county, and other
 
14           funds as may become available to support metropolitan
 
15           transportation[.] planning;
 
16    [(12)  Advise] (11)  Advising on plans, projects and programs
 
17           requiring action by the state legislature or the
 
18           legislative body of the county which have been
 
19           submitted for review to the [MPO.] metropolitan
 
20           planning organization;
 
21    [(13)  Undertake] (12)  Undertaking such other functions as
 
22           may become appropriate in an advisory capacity to

 1           ensure a joint planning process between the county and
 
 2           the State, and advise appropriate legislative bodies
 
 3           and agencies, as necessary[.]; and
 
 4    [(14)] (13)  If the [MPO] metropolitan planning organization
 
 5           finds that it is necessary to have a citizens' advisory
 
 6           group to present technical or other expert opinions or
 
 7           facts to the [MPO] metropolitan planning organizations
 
 8           then such a group may be formed."
 
 9      SECTION 2.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored.
 
11      SECTION 3.  This Act shall take effect upon its approval.
