DESCRIPTION:
Increases MPO members from 13 to 15 by adding the chairperson of
the citizens' advisory group and a citizen member appointed by
the governor who represents the private sector transportation

                   A  BILL  FOR  AN  ACT

RELATING TO THE METROPOLITAN PLANNING ORGANIZATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 279E-3, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§279E-3 Metropolitan Planning Organization membership.
 
 4 The MPO shall consist of a policy committee and appropriate
 
 5 staff.  The MPO policy committee shall consist of [thirteen]
 
 6 fifteen members.  These members shall include:
 
 7      (1)  Five members of the legislative body of the appropriate
 
 8           county;
 
 9      (2)  Three members of the state senate:
 
10           (A)  One of whom shall be chairperson of the senate
 
11                committee with primary responsibility for
 
12                transportation issues.  In the event there is more
 
13                than one chairperson of the senate committee with
 
14                primary responsibility for transportation issues,
 
15                the senate president shall identify the
 
16                chairperson who shall serve on the MPO policy
 
17                committee and who shall not be required to be a
 
18                resident of the appropriate county; and
 
19           (B)  Two of whom shall be residents of the appropriate

 1                county and shall be appointed by the senate
 
 2                president;
 
 3      (3)  Three members of the state house of representatives:
 
 4           (A)  One of whom shall be the chairperson of the
 
 5                committee of the house of representatives with
 
 6                primary responsibility for transportation issues;
 
 7                and
 
 8           (B)  Two of whom shall be residents of the appropriate
 
 9                county and shall be appointed by the speaker of
 
10                the house;
 
11      (4)  One member who shall be the director of transportation;
 
12           [and]
 
13      (5)  One member who shall be the director of the appropriate
 
14           county department assigned primary responsibility for
 
15           transportation planning[.];
 
16      (6)  One member who shall be the chairperson of the citizen
 
17           advisory group of the Metropolitan Planning
 
18           Organization; and
 
19      (7)  One member who shall be a member appointed by the
 
20           governor representing the private sector transportation
 
21           industry in the appropriate county.
 
22      Each member of the MPO policy committee who is a member of
 
23 the state legislature or the legislative body of the county shall

 1 serve for the same term as the term of office for which the
 
 2 member is elected.  There shall be no remuneration for this
 
 3 service.
 
 4      Vacancies in the MPO policy committee that occur shall be
 
 5 filled in the same manner in which the original member was
 
 6 appointed."
 
 7      SECTION 2.  Section 279E-7, Hawaii Revised Statutes, is
 
 8 amended to read as follows:
 
 9      "[[]§279E-7[]]  Functions of the Metropolitan Planning
 
10 Organization.  The functions of each Metropolitan Planning
 
11 Organization shall include:
 
12      (1)  [Serve] Serving in an advisory capacity to the
 
13           legislature, the legislative body of the county, and
 
14           the appropriate state and county agencies in carrying
 
15           out continuous, comprehensive and cooperative
 
16           transportation planning and programming for the county
 
17           as required by federal laws and rules.
 
18      (2)  [Obtain] Obtaining information and plans from the
 
19           appropriate county and state agencies to formulate a
 
20           short-range six-year transportation plan for the county
 
21           and an annual update of that plan, and a master multi-
 
22           modal long-range transportation plan for the county in
 
23           order to advise the legislature, the legislative body

 1           of the county, and other appropriate agencies regarding
 
 2           those plans.
 
 3      (3)  [Review] Reviewing the capital improvement programs of
 
 4           both the county and state for urbanized and rural areas
 
 5           of the county as they concern transportation.
 
 6      (4)  [Integrate] Integrating transportation planning for the
 
 7           county with a statewide transportation planning program
 
 8           authorized by Act 218, SLH 1974.
 
 9      (5)  [Develop] Developing recommendations to the state
 
10           legislature and the legislative body of the county
 
11           regarding transportation policy matters.
 
12      (6)  [Act] Acting as liaison with the intermodal planning
 
13           group of the secretary of transportation.
 
14      (7)  [Coordinate] Coordinating the mathematical modeling
 
15           essential to the transportation planning process of the
 
16           county.
 
17      (8)  [Ensure] Ensuring a continuing, comprehensive
 
18           transportation planning process carried on
 
19           cooperatively by the State and the county.
 
20      (9)  [Develop] Developing a formula for the distribution of
 
21           metropolitan planning funds which shall consider but
 
22           not necessarily be limited to population, status of
 
23           planning, and metropolitan area transportation needs,

 1           and submit this formula for approval by the secretary
 
 2           of transportation.
 
 3     (10)  [Receive] Receiving and [distribute,] distributing, as
 
 4           necessary, federal funds under Section 112 of the
 
 5           Federal-Aid Highway Act of 1973, the Urban Mass
 
 6           Transportation Act of 1964, as amended, Section 13 of
 
 7           the Airport and Airway Development Act of 1970, as
 
 8           amended, and Section 5 of the Urban Mass Transportation
 
 9           Act of 1964, as amended.
 
10     (11)  [Receive] Receiving and [distribute,] distributing, as
 
11           necessary, such other funds as may become available to
 
12           support metropolitan transportation.
 
13     (12)  [Advise] Advising on plans, projects and programs
 
14           requiring action by the state legislature or the
 
15           legislative body of the county which have been
 
16           submitted for review to the MPO.
 
17     (13)  [Undertake] Undertaking such other functions as may
 
18           become appropriate in an advisory capacity to ensure a
 
19           joint planning process between the county and the
 
20           State, and advise appropriate legislative bodies and
 
21           agencies, as necessary[.]; and
 
22     (14)  [If the MPO finds that it is necessary to have a
 
23           citizens' advisory group to present technical or other

 1           expert opinions or facts to the MPO then such a group
 
 2           may be formed.] Forming a citizens' advisory group to
 
 3           present technical or other expert opinions or facts to
 
 4           the MPO."
 
 5      SECTION 3.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 4.  This Act shall take effect upon its approval.
