DESCRIPTION:
Removes trailer exemptions from prohibitions relating to
possession or consumption of intoxicating liquors in motor
vehicles.  Prohibits drivers from consuming intoxicating liquors

                   A  BILL  FOR  AN  ACT

RELATING TO HIGHWAY SAFETY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291-3.1, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  [This section shall not apply to the living quarters
 
 4 of a trailer or camper.] The driver of a motor vehicle or moped,
 
 5 whether operating the motor vehicle or moped or not, shall not at
 
 6 any time consume intoxicating liquor or possess any bottle, can,
 
 7 or other receptacle containing any intoxicating liquor that has
 
 8 been opened, or had a seal broken, or had the contents partially
 
 9 removed, while in the motor vehicle or on any moped."
 
10      SECTION 2.  Section 291-3.2, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "§291-3.2  Consuming or possessing intoxicating liquor while
 
13 a passenger in a motor vehicle.(a)  No person shall consume any
 
14 intoxicating liquor while a passenger in any motor vehicle or on
 
15 any moped upon any public street, road, or highway.
 
16      (b)  No person shall possess, while a passenger in a motor
 
17 vehicle or on a moped upon any public street, road, or highway,
 
18 any bottle, can, or other receptacle containing any intoxicating
 
19 liquor which has been opened, or a seal broken, or the contents

 1 of which have been partially removed.
 
 2      [(c)  This section shall not apply to the living quarters of
 
 3 a trailer or camper.
 
 4      (d)] (c)  Any person violating this section shall be guilty
 
 5 of a petty misdemeanor."
 
 6      SECTION 3.  Section 291-3.3, Hawaii Revised Statutes, is
 
 7 amended by amending subsection (c) to read as follows:
 
 8      "(c)  Subsection (a) [of this section] shall not apply to a
 
 9 recreational or other vehicle not having a separate trunk
 
10 compartment[, or to the living quarters of a trailer or camper]."
 
11      SECTION 4.  Statutory material to be repealed is bracketed.
 
12 New statutory material is underscored.
 
13      SECTION 5.  This Act shall take effect upon its approval.
