                   A  BILL  FOR  AN  ACT

RELATING TO FINANCIAL DISCLOSURE REQUIREMENTS.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  In compliance with section 84-17, Hawaii Revised
 
 2 Statutes, candidates who currently hold state office file
 
 3 financial disclosures twice during election years:  once between
 
 4 January 1 and May 31 as a state official, and then again in
 
 5 August as a candidate when running for re-election or another
 
 6 office.  This usually results in duplicate filing since there are
 
 7 only three months between the two filing deadlines.
 
 8      The purpose of this Act is to eliminate duplicate filings by
 
 9 exempting candidates from having to file an initial financial
 
10 disclosure if they have already filed as a state official in an
 
11 election year.
 
12      SECTION 2.  Section 84-17, Hawaii Revised Statutes, is
 
13 amended by amending subsection (c) to read as follows:
 
14      "(c)  The following persons shall file annually with the
 
15 state ethics commission a disclosure of financial interests:
 
16      (1)  The governor, the lieutenant governor, the members of
 
17           the legislature, and delegates to the constitutional
 
18           convention; provided that delegates to the
 
19           constitutional convention shall only be required to

 1           file initial disclosures;
 
 2      (2)  The directors and their deputies, the division chiefs,
 
 3           the executive directors and the executive secretaries
 
 4           and their deputies, the purchasing agents and the
 
 5           fiscal officers, regardless of the titles by which the
 
 6           foregoing persons are designated, of every state agency
 
 7           and department;
 
 8      (3)  The permanent employees of the legislature and its
 
 9           service agencies, other than persons employed in
 
10           clerical, secretarial, or similar positions;
 
11      (4)  The administrative director of the State, and the
 
12           assistants in the office of the governor and the
 
13           lieutenant governor, other than persons employed in
 
14           clerical, secretarial, or similar positions;
 
15      (5)  The hearings officers of every state agency and
 
16           department;
 
17      (6)  The president, the vice presidents, assistant vice
 
18           presidents, the chancellors, and the provosts of the
 
19           University of Hawaii and its community colleges;
 
20      (7)  The superintendent, the deputy superintendent, the
 
21           assistant superintendents, the district
 
22           superintendents, the state librarian, and the deputy
 
23           state librarian of the department of education;

 1      (8)  The administrative director and the deputy director of
 
 2           the courts;
 
 3      (9)  The members of every state board or commission whose
 
 4           original terms of office are for periods exceeding one
 
 5           year and whose functions are not solely advisory;
 
 6     (10)  Candidates for state elective offices, including
 
 7           candidates for election to the constitutional
 
 8           convention, provided that candidates shall only be
 
 9           required to file initial disclosures; provided that
 
10           candidates have not already filed between January 1 and
 
11           May 31 as a state official for the disclosure period;
 
12           and
 
13     (11)  The administrator and assistant administrator of the
 
14           office of Hawaiian affairs."
 
15      SECTION 3.  New statutory material is underscored.
 
16      SECTION 4.  This Act shall take effect upon its approval.
