                     A BILL FOR AN ACT

RELATING TO STD/AIDS PREVENTION PROGRAMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Section 321-111, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§321-111  Sexually transmitted disease prevention program.
 
 4 (a)  The departments of health and education shall cooperate with
 
 5 each other and other public and private authorities as they may
 
 6 deem advisable for the education of minors and members of the
 
 7 general public on sexually transmitted diseases and the
 
 8 prevention of sexually transmitted diseases.  For the purpose of
 
 9 this section, "minor" means any person fourteen years of age or
 
10 older and under the age of majority.
 
11      (b)  The department of health shall formulate, supervise,
 
12 and coordinate throughout the State an educational program for
 
13 the purposes of preventing sexually transmitted diseases,
 
14 instructing the general public in detecting the diseases, and
 
15 encouraging early treatment.
 
16      (c)  The information shall be made available upon request to
 
17 all minors and members of the general public without parental
 
18 consent and the information shall be distributed to all public
 
19 school counselors requesting educational materials concerning

 1 sexually transmitted disease prevention, detection, and
 
 2 treatment.
 
 3      (d)  Any program or service established pursuant to this
 
 4 section for the prevention of the spread of sexually transmitted
 
 5 diseases or AIDS shall be provided, without any spend-down
 
 6 requirement, to people who derive their income solely or largely
 
 7 from social security, if they have a serious sexually transmitted
 
 8 disease or AIDS that results in any of the following:
 
 9           (1) Terminal illness--a licensed physician (preferably
 
10           the patient's own physician) has attested in writing
 
11           that due to the nature of the patient's condition, the
 
12           patient's life expectancy is expected to be six months
 
13           or less.
 
14           (2) Debilitating illness--the patient has a serious
 
15           sexually transmitted disease, AIDS or related medical
 
16           condition which prevents him/her from functioning
 
17           independently and that he/she cannot do two or more of
 
18           the following:
 
19                (A) Communicate needs or wants;
 
20                (B) Self feed;
 
21                (C) Ambulate without the assistance of another
 
22                person; or
 
23                (D) Walk with or without the help of a device.

 1           (3) Life threatening illness--a licensed physician
 
 2           (preferably the patient's own physician) has attested
 
 3           in writing that the patient has a serious sexually
 
 4           transmitted disease or AIDS condition held in abeyance
 
 5           due to condition-specific medication or treatment which
 
 6           if withheld from the patient, would eventually lead to
 
 7           death (after first passing through the aforementioned
 
 8           two categories of eligibility)."
 
 9      SECTION 2.  Chapter 321, Part X, Hawaii Revised Statutes, is
 
10 amended by adding a new section to be appropriately designated
 
11 and to read as follows:
 
12      "§321-    Annual appropriation.  (a) Commencing with July 1,
 
13 1999, and every year thereafter, there shall be appropriated out
 
14 of the general revenues of the State of Hawaii the sum of $    ,
 
15 or so much thereof as may be necessary to carry out the
 
16 provisions of section 321-111, including matching any federal
 
17 funds to support individuals in the categories defined in said
 
18 section.
 
19      (b)  The sum appropriated shall be expended by the
 
20 departments of health and education for the purposes set forth in
 
21 section 321-111."
 
22      SECTION 3.  New statutory material is underscored.

 1      SECTION 4.  This Act shall take effect upon its approval;
 
 2 provided that section 2 shall take effect on July 1, 1999.
