DESCRIPTION:
Grants teachers automatic annual salary increments and longevity
step increases without regard to the number of in-service,
university, or other credits earned by a teacher, notwithstanding

                   A  BILL  FOR  AN  ACT

RELATING TO PERSONNEL OF THE DEPARTMENT OF EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-624, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§302A-624[]]  Teachers salary schedule.(a)  The salary
 
 4 schedule for all teachers of the department of education shall be
 
 5 negotiated pursuant to section 89-9[.
 
 6      (b)  All teachers must meet the following requirements:
 
 7      (1)  A teacher must earn at least five credits within a
 
 8           three-year cycle in order to receive increment or
 
 9           longevity step increases in the third year of the
 
10           three-year cycle;
 
11      (2)  A teacher who fails to meet the requirement set forth
 
12           in paragraph (1) shall not be eligible for any
 
13           increment or longevity step increases until the teacher
 
14           earns the credit requirement for the three-year cycle;
 
15      (3)  Any credit earned in excess of any three-year credit
 
16           requirement may not be carried over beyond the three-
 
17           year cycle; and
 
18      (4)  Credits earned can be in the form of in-service,
 
19           university, or other credits approved by the

 1           department.], except with respect to the granting of
 
 2           automatic annual increments and longevity step
 
 3           increases pursuant to section 302A-626.
 
 4      (b)  Notwithstanding section 89-19 to the contrary,
 
 5 automatic annual salary increments and longevity step increases
 
 6 shall be granted without regard to the number of in-service,
 
 7 university, or other credits earned by a teacher.
 
 8      (c)  A teacher is required to spend at least one year in
 
 9 Class III before going on to Class IV, at least one year in Class
 
10 IV before going on to Class V, at least one year in Class V
 
11 before going on to Class VI, and at least one year in Class VI
 
12 before going on to Class VII.
 
13      (d)  In case of promotion from a teaching position to an
 
14 educational officer, the employee shall receive compensation at
 
15 the lowest step of the higher grade that exceeds the employee's
 
16 existing compensation by at least eight per cent if such a step
 
17 exists.
 
18      (e)  Effective July 1, 1996, the per diem rate for
 
19 substitute teachers shall be based on the annual entry step
 
20 salary rate established for a Class II teacher on the most
 
21 current teachers' salary schedule.  The per diem rate shall be
 
22 derived from the annual rate in accordance with the following
 
23 formula:

 1           Per Diem Rate = Annual Salary Rate -: 12 months -: 21
 
 2                  Average Working Days Per Month"
 
 3      SECTION 2.  Section 302A-626, Hawaii Revised Statutes, is
 
 4 amended to read as follows:
 
 5      "[[]§302A-626[]]  Salary increases; annual, longevity.(a)
 
 6 [Teachers and educational officers] Notwithstanding section 89-19
 
 7 and section 302A-624 to the contrary, teachers who have completed
 
 8 a year's satisfactory service and who have complied with the
 
 9 other requirements of sections 302A-602 to 302A-640, and
 
10 302A-701, shall be entitled to an automatic annual increment.
 
11      Educational officers who have completed a year's
 
12 satisfactory service and who have complied with the other
 
13 requirements of sections 302A-602 to 302A-640, and 302A-701,
 
14 shall be entitled to an annual increment.
 
15      (b)  [Teachers and educational officers] Notwithstanding
 
16 section 89-19 and section 302A-624 to the contrary, teachers who
 
17 have served satisfactorily for three years in their maximum
 
18 increment step or in any longevity step and who have complied
 
19 with the other requirements of sections 302A-602 to 302A-640, and
 
20 302A-701, shall receive automatic longevity step increases.
 
21      Educational officers who have served satisfactorily for
 
22 three years in their maximum increment step or in any longevity
 
23 step and who have complied with the other requirements of

 1 sections 302A-602 to 302A-640, and 302A-701, shall receive
 
 2 longevity step increases."
 
 3      SECTION 3.  Statutory material to be repealed is bracketed.
 
 4 New statutory material is underscored.
 
 5      SECTION 4.  This Act shall take effect upon its approval.
