Group Living Facilities


DESCRIPTION:
Prohibits the construction or maintenance of a group living
facility within 1,000 feet of any other group living facility by

                   A  BILL  FOR  AN  ACT

RELATING TO GROUP LIVING FACILITIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended
 
 2 by adding a new part to be appropriately designated and to read
 
 3 as follows:
 
 4                 "PART  .  GROUP LIVING FACILITIES
 
 5      §46-  Definitions.  For purposes of this part:
 
 6      "Family" means one or more persons, all related by blood,
 
 7 adoption, or marriage, occupying a dwelling unit or lodging unit.
 
 8 A family may also be defined as no more than five unrelated
 
 9 persons.
 
10      In addition, eight or fewer persons who reside in an adult
 
11 residential care home, a special treatment facility, or other
 
12 similar facility monitored or licensed by the State shall be
 
13 considered a family.  Resident managers or supervisors shall not
 
14 be included in this residential count.
 
15      "Group living facilities" means facilities which are used to
 
16 provide living accommodations and, in some cases, care services.
 
17 Included are:
 
18      (1)  Monasteries and convents, and dwelling units that are
 
19           used to provide living accommodations and care services
 
20           under a residential setting to individuals who are

 1           handicapped, aged, disabled, or undergoing
 
 2           rehabilitation.  These are typically identified as
 
 3           group homes, halfway houses, homes for children, the
 
 4           elderly, battered children and adults, recovery homes,
 
 5           independent group living facilities, hospices, and
 
 6           other similar facilities;
 
 7      (2)  Facilities that provide services, including medical
 
 8           care, and are identified as convalescent homes, nursing
 
 9           homes, sanitariums, intermediate-care or extended-care
 
10           facilities, and other similar facilities; and
 
11      (3)  Living facilities with accommodations for more than
 
12           five resident individuals, except those meeting the
 
13           definition of family.  Resident managers or supervisors
 
14           shall not be included in this resident count.
 
15      §46-  Construction of group living facilities.  No group
 
16 living facility shall be constructed or maintained by any
 
17 governmental authority within one thousand feet of any other
 
18 group living facility."
 
19      SECTION 2.  This Act shall take effect upon its approval.
