                   A  BILL  FOR  AN  ACT

RELATING TO HAWAII KAI PERFORMING ARTS AND TECHNOLOGY CENTER.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Findings.  In today's global society, Hawaii is
 
 2 now reaching out to diverse groups.  In the redirection of
 
 3 tourism promotion, such as cultural, ecotourism, technology, and
 
 4 sports, it is important to facilitate the State's specialty
 
 5 markets.  A Hawaii Kai performing arts and technology center will
 
 6 serve as a gathering place for the community and a showcase for
 
 7 the State.  There are currently no facilities available to house
 
 8 drama, band, television production, fine arts, and technology for
 
 9 students residing in Hawaii Kai and other residents of east Oahu.
 
10 The drama department of Kaiser high school must bus all students
 
11 to Hawaii Theatre, the band performs in the gymnasium, the local
 
12 community access channel has been rescinded, and television
 
13 production is relegated to a closet-like space.  The technology
 
14 center will allow a computer refurbishing center to flourish,
 
15 putting needed computers into classrooms.  Gifted and talented
 
16 students must be nurtured into productive and skilled workers of
 
17 tomorrow.  The community will have a place to meet and to
 
18 showcase Hawaii's diverse cultures.  Exchange programs will
 
19 enliven understanding of the new global economy.

 1      SECTION 2.  Establishment.  The legislature hereby
 
 2 establishes the Hawaii Kai performing arts and technology center,
 
 3 a public institution for the students of Hawaii Kai and residents
 
 4 of east Oahu.  The purpose of the Hawaii Kai performing arts and
 
 5 technology center is to revitalize east Oahu by establishing a
 
 6 performing arts theatre and technology center.  The performing
 
 7 arts theatre shall be at Kaiser high school in conjunction with
 
 8 the expanded sports complex.
 
 9      SECTION 3.  Responsibilities.  The State shall provide
 
10 funding for design, planning, and construction for the center.
 
11 Kaiser high school shall organize, promote, and operate the
 
12 Hawaii Kai performing arts and technology center.  The state
 
13 foundation on culture and the arts shall provide oversight and
 
14 approve the entity's budget.  Moneys earned from the sale of
 
15 tickets shall be deposited into the state general fund.  Any
 
16 profits from the Hawaii Kai performing arts and technology center
 
17 shall be transferred to the state foundation on culture and the
 
18 arts for the specific purpose of funding culture and arts
 
19 programs throughout the State, including sending representatives
 
20 of Hawaii schools worldwide to foster understanding and to
 
21 promote Hawaii as a visitor destination.
 
22      SECTION 4.  General obligation bonds.  The director of
 
23 finance is authorized to issue general obligation bonds in the

 1 sum of $          , or so much thereof as may be necessary, and
 
 2 the same sum, or so much thereof as may be necessary, is
 
 3 appropriated for fiscal year 1999-2000, for the purpose of
 
 4 designing the Hawaii Kai performing arts and technology center
 
 5 complex, to include a state of the art performing arts theatre
 
 6 seating between nine hundred and one thousand two hundred people
 
 7 per show.
 
 8      SECTION 5.  The appropriations authorized in this Act shall
 
 9 not lapse at the end of the fiscal biennium for which the
 
10 appropriation is made; provided that all appropriations which are
 
11 unencumbered as of June 30, 2003, shall lapse as of that date.
 
12      SECTION 6.  The sum appropriated shall be expended by the
 
13 department of accounting and general services for the purposes of
 
14 this Act.
 
15      SECTION 7.  This Act shall take effect on July 1, 1999.
