                   A  BILL  FOR  AN  ACT
RELATING TO MINORS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Chapter 286, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§286-    Minors; effect of conviction on driver's license.
 
 5 (a)  If any minor under eighteen years of age, but fifteen or
 
 6 over, is found by a court of competent jurisdiction to have
 
 7 committed an act that would constitute any offense under part IV
 
 8 of chapter 712, the court immediately shall revoke the minor's
 
 9 driving privileges for not less than six months and not more than
 
10 two years.  The court shall impose this penalty in addition to
 
11 any other authorized by law and regardless of whether the minor
 
12 was operating a motor vehicle at the time of the offense.
 
13      (b)  The court shall notify the examiner of drivers, within
 
14 twenty-four hours after the entry of judgment, that the minor's
 
15 driving privileges are revoked, and the notice shall indicate the
 
16 revocation period imposed.  No minor shall be allowed to obtain a
 
17 license or special license during the period in which the minor's
 
18 driving privilege is revoked.  If the minor already has a license
 
19 or a special license, the court shall require the minor to

 1 surrender the license or special license to the court for the
 
 2 period of revocation.
 
 3      (c)  After the expiration of the revocation period, the
 
 4 examiner of drivers may restore the minor's driving privileges
 
 5 upon application by the minor which includes a certification from
 
 6 a physician licensed under chapter 453 or 460 that the minor is
 
 7 not drug dependent."
 
 8      SECTION 2.  This Act does not affect rights and duties that
 
 9 matured, penalties that were incurred, and proceedings that were
 
10 begun, before its effective date.
 
11      SECTION 3.  New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
