                     A BILL FOR AN ACT

RELATING TO DISABLED PARKING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  The legislature finds that the blind have as
 
 2 much difficulty going places as other disabled persons.  The
 
 3 blind who are fortunate to have the availability of other persons
 
 4 to drive them around are at a disadvantage if the drivers are not
 
 5 allowed to park in disabled parking.
 
 6      Current law does not clearly state whether the blind are
 
 7 entitled to disabled parking placards.  Therefore, the purpose of
 
 8 this Act is clarify the definition of "disabled person" to
 
 9 include the blind so that the blind may obtain disabled parking
 
10 plackards.
 
11      SECTION 2.  Section 291-51, Hawaii Revised Statutes, is
 
12 amended to read as follows:
 
13      "§291-51  Definitions.  As used in this part, the following
 
14 terms have the following meanings:
 
15      "Certificate of disability" means a medical statement issued
 
16 by a licensed practicing physician, which verifies that a person
 
17 is disabled, limited, or impaired in the ability to walk.
 
18      "Disabled person" means a person with a disability which
 
19 limits or impairs the ability to walk or see, and who, as

 1 determined by a licensed practicing physician:
 
 2      (1)  Cannot walk two hundred feet without stopping to rest,
 
 3           due to a diagnosed arthritic, neurological, or
 
 4           orthopedic condition;
 
 5      (2)  Cannot walk without the use of, or assistance from, a
 
 6           brace, cane, crutch, another person, prosthetic device,
 
 7           wheelchair, or other assistive device;
 
 8      (3)  Is restricted by lung disease to such an extent that
 
 9           the person's forced (respiratory) expiratory volume for
 
10           one second, when measured by spirometry, is less than
 
11           one liter, or the arterial oxygen tension is less than
 
12           sixty mm/hg on room air at rest;
 
13      (4)  Uses portable oxygen; [or]
 
14      (5)  Has a cardiac condition to the extent that the person's
 
15           functional limitations are classified in severity as
 
16           Class III or Class IV according to the standards set by
 
17           the American Heart Association[.]; or
 
18      (6)  Is legally blind."
 
19      SECTION 3.  Statutory material to be repealed is bracketed.
 
20 New statutory material is underscored.
 
21      SECTION 4.  This Act shall take effect upon its approval.
