                   A  BILL  FOR  AN  ACT

RELATING TO PERSONAL IDENTIFICATION.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  In the State of Hawaii, the drivers' license
 
 2 identification number is the same as the driver's social security
 
 3 number.  For many years, the use of the social security number
 
 4 has been a convenience for Hawaii's citizens.
 
 5      Unfortunately, with the rise of technology, the privacy of
 
 6 our citizens is at a new low.  With only basic information, high-
 
 7 tech snoopers can obtain confidential financial and other
 
 8 information.  As a result, perpetrators of fraud are able to
 
 9 generate authentic-looking financial instruments (including
 
10 credit cards) and inflict damage upon innocent citizens and
 
11 businesses.
 
12      Hawaii must respond to this threat by taking the simple
 
13 measure of changing the Drivers' License Number to a number
 
14 unrelated to the drivers' social security number.  This simple
 
15 step will dramatically reduce the readily-available information
 
16 concerning our citizens.
 
17      Additionally, the social security number should be removed
 
18 from the state identification and changed to another unrelated
 
19 number.

 1      This Act also requires that citizenship status be placed on
 
 2 the driver's license and that the time period in which a state 
 
 3 identification for a U.S. citizen is valid be extended from 6
 
 4 years to 10 years.
 
 5      SECTION 2.  Section 285-109, Hawaii Revised Statutes, is
 
 6 amended to read as follows:
 
 7      "§286-109  General provision governing the issuance of
 
 8 licenses.  Upon payment of the required fee and upon
 
 9 demonstrating the ability to operate a certain category or
 
10 categories of motor vehicles to the satisfaction of the examiner
 
11 of drivers, an applicant for a driver's license shall be issued a
 
12 single license of a design approved by the director of
 
13 transportation upon which is made a notation of the category or
 
14 categories of motor vehicles the applicant may operate, any
 
15 restrictive provisions to which the license is subject, and,
 
16 where the license is issued to a person under twenty-one years of
 
17 age, a statement, in clearly legible print that shall contrast
 
18 with the other information appearing on the license, which
 
19 indicates the date on which the person will attain the age of
 
20 twenty-one years.
 
21      Statutes of limitations and other provisions of this chapter
 
22 notwithstanding, no driver's license or instruction permit shall
 
23 be issued or renewed under this section, where the examiner of

 1 drivers is notified by the district judge, traffic violations
 
 2 bureaus of the district courts, or the judge of the circuit court
 
 3 that the applicant has failed to respond to a traffic citation or
 
 4 summons for the violation of any traffic laws of a county, this
 
 5 chapter or chapters 286G, 287, 290, 291, or 291C, and the same
 
 6 remains delinquent and outstanding, or the applicant, having
 
 7 timely responded initially, has as of the time of the
 
 8 application, failed to comply in full with all orders of the
 
 9 court.
 
10      No driver's license or instruction permit certificate shall
 
11 visibly bear anyone's social security number.  For purposes of
 
12 this section, "driver's license certificate" and "instruction
 
13 permit certificate" means the card or certificate issued to
 
14 represent a valid driver's license or instruction permit.  The
 
15 counties currently visibly utilizing a person's social security
 
16 number on a driver's license or instruction permit certificate
 
17 may comply with this section by visibly removing the social
 
18 security number and substituting an identification number
 
19 unrelated to the person's social security number at the time of
 
20 the renewal of the license or permit certificate.
 
21      The driver's license shall include the citizenship status of
 
22 the person to whom the license is issued."
 
23      SECTION 3.  Section 286-239, Hawaii Revised Statutes, is

 1 amended by amending subsection (a) to read as follows:
 
 2      "§286-239  Commercial driver's license.  (a)  The commercial
 
 3 driver's license shall be marked "CDL" and, to the maximum extent
 
 4 practicable, shall be tamperproof and include, but not be limited
 
 5 to, the following with respect to the licensee:
 
 6      (1)  The name and residence address;
 
 7      (2)  A color photograph;
 
 8      (3)  A physical description including sex and height;
 
 9      (4)  Date of birth;
 
10      [(5) Social security number;]
 
11      (5)  Citizenship status;
 
12      (6)  Signature;
 
13      (7)  The class or type of commercial motor vehicle or
 
14           vehicles which may be driven together with any
 
15           endorsements or restrictions;
 
16      (8)  The name of this State; and
 
17      (9)  The issuance and expiration dates of the license."
 
18      SECTION 4.  Section 846-30, Hawaii Revised Statutes, is
 
19 amended to read as follows:
 
20      "§846-30  Identification certificates; form.  The department
 
21 of the attorney general, after taking the thumbprint of each
 
22 registrant as provided in this part (except as otherwise provided
 
23 in the case of children under three years of age), and after

 1 securing the information required by or pursuant to this part,
 
 2 shall issue to each registrant a certificate of identification in
 
 3 such form, and with such information, as the attorney general
 
 4 deems necessary and practicable, the certificate to contain,
 
 5 among other things:  [the registrant's social security number;]
 
 6 the date of issue; the legal name, residence, citizenship, date
 
 7 of birth, the registrant's signature, a facsimile signature of
 
 8 the attorney general, a facsimile signature of the officer or
 
 9 employee issuing the certificate (to be designated as the
 
10 "administrator of the data center"), the name and address of the
 
11 person to be notified in case of need, and such other personal
 
12 identification data as the attorney general deems necessary and
 
13 practicable. 
 
14      SECTION 5.  Section 846-30.5, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "[[]§846-30.5[]]  Expiration date.  Every certificate of
 
17 identification issued under this part, whether an original or a
 
18 renewal, shall bear an expiration date which shall be [six] ten
 
19 years after the date of issuance; provided that if the person is
 
20 a legal nonimmigrant, the certificate shall bear an expiration
 
21 date that is the same as the expiration date on the person's
 
22 Immigration and Naturalization Service departure card (I-94).
 
23 All certificates of identification issued without expiration

 1 dates shall expire on December 31, 1999. 
 
 2      SECTION 6.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 7.  This Act shall take effect upon its approval.
