                   A  BILL  FOR  AN  ACT

RELATING TO WASTEWATER REUSE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that Hawaii is blessed
 
 2 with an abundance of freshwater.  However, the future
 
 3 sustainability of freshwater is not so certain.  Demands for
 
 4 water may outpace our available supplies.  Therefore, we need to
 
 5 look to other sources of water for agricultural, irrigation, and
 
 6 industrial uses.  One such source is wastewater reuse.  Other
 
 7 states where water is short are doing a lot more to reuse
 
 8 wastewater.  Hawaii can do much more to close the water recycle
 
 9 gap.  State laws and rules need to be changed to encourage the
 
10 reuse of water, to authorize the distribution and sale of
 
11 recycled water, and to clarify who is liable for the health and
 
12 environmental risks of recycling treated water.
 
13      SECTION 2.  Section 342D-1, Hawaii Revised Statutes, is
 
14 amended by amending the definition of "wastewater" to read as
 
15 follows:
 
16      ""Wastewater" means [any liquid waste, whether treated or
 
17 not, and whether animal, mineral, or vegetable including
 
18 agricultural, industrial, and thermal wastes.] the spent or used
 
19 water from a community or industry that contains dissolved or

 1 suspended matter, other than recycled water."
 
 2      SECTION 3.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 4.  This Act shall take effect upon its approval.
