illegal activities that cause the building, premise, or place

                   A  BILL  FOR  AN  ACT

RELATING TO NUISANCE ABATEMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 712-1270, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§712-1270  Places used to commit offenses against public
 
 4 health and morals, a nuisance.  Every building, premises, or
 
 5 place used for the purpose of violating those laws pertaining to
 
 6 offenses against public health and morals contained in parts I,
 
 7 II, III, and IV of this chapter[,] and offenses against public
 
 8 order, sections 711-1109 and 711-1109.3, except offenses under
 
 9 part IV which do not involve the manufacture or distribution of
 
10 drugs, and every building, premises, or place in or upon which
 
11 the violations are held or occur in parts I, II, III, and IV[,]
 
12 and sections 711-1109 and 711-1109.3, is a nuisance that shall be
 
13 enjoined, abated, and prevented, regardless of whether it is a
 
14 public or private nuisance."
 
15      SECTION 2.  This Act does not affect rights and duties that
 
16 matured, penalties that were incurred, and proceedings that were
 
17 begun, before its effective date.
 
18      SECTION 3.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
