                     A BILL FOR AN ACT

RELATING TO CAMPAIGN FINANCING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Section 11-205.5, Hawaii Revised Statutes, is
 
 2 amended to read:
 
 3      §11-205.5  Campaign contributions by state contractors.(a)
 
 4 Any person making a contribution to any candidate, committee, or
 
 5 political party, and who has received, in any calendar year,
 
 6 $50,000 or more through contracts from the State, or county shall
 
 7 register and report that fact to the commission within thirty
 
 8 days of the date of the contribution or within thirty days of the
 
 9 date of the contract, whichever occurs later; provided that this
 
10 section shall not apply to a person who has received $50,000 or
 
11 more through a grant, subsidy, or purchase of service agreement
 
12 under chapter 42F or 103F.
 
13      (b)  The commission shall prescribe forms and procedures for
 
14 the reporting required in subsection (a) which, at a minimum,
 
15 shall require the following information:
 
16      (1)  The name and address of the person making the
 
17           contribution;
 
18      (2)  The name of the candidate, committee, or political
 
19           party receiving the contribution;

 1      (3)  The amount of money received from the State or county,
 
 2           the dates, and information identifying each contract
 
 3           and describing the service performed or goods provided;
 
 4           and
 
 5      (4)  If an entity is making the contribution, the names and
 
 6           business addresses of the principals, including
 
 7           officers and directors.
 
 8      (c)  The commission shall maintain a list of such reports
 
 9 for public inspection both at the commission's office and through
 
10 the state FYI electronic bulletin board. 
 
11      "(d) Notwithstanding any other law to the contrary, any
 
12           person or entity who makes a campaign contribution or
 
13           renders campaign assistance to any state or county
 
14           official with authority over contract or land-use
 
15           approval shall be ineligible to obtain said approval
 
16           for a period of two years from the making of such 
 
17           contribution or assistance."
 
18      SECTION 2.  New statutory material is underscored.
 
19      SECTION 3.  This Act shall take effect upon its approval.
