                   A  BILL  FOR  AN  ACT

RELATING TO DRIVER'S LICENSES.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  In the State of Hawaii, the drivers' license
 
 2 identification number is the same as the driver's social security
 
 3 number.  For many years, the use of the social security number
 
 4 has been a convenience for Hawaii's citizens.
 
 5      Unfortunately, with the rise of technology, the privacy of
 
 6 our citizens is at a new low.  With only basic information, high-
 
 7 tech snoopers can obtain confidential financial and other
 
 8 information.  As a result, perpetrators of fraud are able to
 
 9 generate authentic-looking financial instruments (including
 
10 credit cards) and inflict damage upon innocent citizens and
 
11 businesses.
 
12      Hawaii must respond to this threat by taking the simple
 
13 measure of changing the Drivers' License Number to a number
 
14 unrelated to the drivers' social security number.  This simple
 
15 step will dramatically reduce the readily-available information
 
16 concerning our citizens.
 
17      SECTION 2.  Section 285-109, Hawaii Revised Statutes, is
 
18 amended to read as follows:
 
19      "§286-109  General provision governing the issuance of

 1 licenses.  Upon payment of the required fee and upon
 
 2 demonstrating the ability to operate a certain category or 
 
 3 categories of motor vehicles to the satisfaction of the examiner
 
 4 of drivers, an applicant for a driver's license shall be issued a
 
 5 single license of a design approved by the director of
 
 6 transportation upon which is made a notation of the category or
 
 7 categories of motor vehicles the applicant may operate, any
 
 8 restrictive provisions to which the license is subject, and,
 
 9 where the license is issued to a person under twenty-one years of
 
10 age, a statement, in clearly legible print that shall contrast
 
11 with the other information appearing on the license, which
 
12 indicates the date on which the person will attain the age of
 
13 twenty-one years.
 
14      Statutes of limitations and other provisions of this chapter
 
15 notwithstanding, no driver's license or instruction permit shall
 
16 be issued or renewed under this section, where the examiner of
 
17 drivers is notified by the district judge, traffic violations
 
18 bureaus of the district courts, or the judge of the circuit court
 
19 that the applicant has failed to respond to a traffic citation or
 
20 summons for the violation of any traffic laws of a county, this
 
21 chapter or chapters 286G, 287, 290, 291, or 291C, and the same
 
22 remains delinquent and outstanding, or the applicant, having
 
23 timely responded initially, has as of the time of the

 1 application, failed to comply in full with all orders of the
 
 2 court.
 
 3      No driver's license or instruction permit certificate shall
 
 4 visibly bear anyone's social security number.  For purposes of
 
 5 this section, "driver's license certificate" and "instruction
 
 6 permit certificate" means the card or certificate issued to
 
 7 represent a valid driver's license or instruction permit.  The
 
 8 counties currently visibly utilizing a person's social security
 
 9 number on a driver's license or instruction permit certificate
 
10 may comply with this section by visibly removing the social
 
11 security number and substituting an identification number
 
12 unrelated to the person's social security number at the time of
 
13 the renewal of the license or permit certificate."
 
14      SECTION 3.  Section 286-239, Hawaii Revised Statutes, is
 
15 amended by amending subsection (a) to read as follows:
 
16      "§286-239  Commercial driver's license.  (a)  The commercial
 
17 driver's license shall be marked "CDL" and, to the maximum extent
 
18 practicable, shall be tamperproof and include, but not be limited
 
19 to, the following with respect to the licensee:
 
20      (1)  The name and residence address;
 
21      (2)  A color photograph;
 
22      (3)  A physical description including sex and height;
 
23      (4)  Date of birth;

 1      [(5) Social security number;
 
 2 (6)] (5)  Signature;
 
 3 [(7)](6)  The class or type of commercial motor vehicle or
 
 4           vehicles which may be driven together with any
 
 5           endorsements or restrictions;
 
 6 [(8)](7)  The name of this State; and
 
 7 [(9)](8)  The issuance and expiration dates of the license."
 
 8      SECTION 4.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 5.  This Act shall take effect upon its approval.
