                   A  BILL  FOR  AN  ACT

RELATING TO HIGHWAYS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 264-33.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]264-33.5[]]  Underground installation of utility
 
 4 facilities along federal-aid highways; when required; when
 
 5 waived.(a)  The director of transportation shall arrange for
 
 6 the installation of all utility cables and facilities below the
 
 7 ground, within a berm or away from the alignment of a highway,
 
 8 during the design or redesign and construction or reconstruction
 
 9 phases of any new or existing federal-aid highway project, when a
 
10 determination is made that federal highway funds are available to
 
11 pay for the federal [share of the cost differential between
 
12 underground and overhead facilities.] contribution to the state
 
13 or county share as determined by section 264-33.
 
14      (b)  The director of transportation may make exceptions to
 
15 subsection (a) if:
 
16      (1)  The director determines that exceptions are appropriate
 
17           due to either:
 
18           (A)  Any of the following criteria: environmental,
 
19                safety, research, technology, corridor alignment,

 1                or management concern; or
 
 2           (B)  The following criteria collectively: state funding
 
 3                impacts, economic feasibility, and federal funding
 
 4                concerns; or
 
 5      (2)  The projects do not lend themselves to undergrounding,
 
 6           such as: resurfacing, traffic signal installation,
 
 7           drainage installation, bikeway markings, guardrail
 
 8           installation, traffic markings, and enhancement
 
 9      improvements.
 
10      (c)  All associated undergrounding costs outside of the
 
11 public right-of-way shall be borne by the utility companies, or
 
12 the benefitting private property owners or both, as the case may
 
13 be."
 
14      SECTION 2.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 3.  This Act shall take effect on July 1, 1999.
