                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that it is critical to
 
 2 provide all public school students with safe school environments.
 
 3 Consequently, the legislature has supported the schools through
 
 4 the adoption of acts which allow the long-term exclusion from
 
 5 school of students who commit serious offenses.  Schools,
 
 6 however, need educational alternatives to readily remove from
 
 7 campus students who impede the learning process from occurring in
 
 8 a safe and orderly environment.  At the same time, the department
 
 9 of education recognizes its obligation to provide these students
 
10 with substitute educational activities.
 
11      This Act provides for educational alternatives.  Each school
 
12 placing students in these educational alternatives shall pay the
 
13 pro-rated, statewide per pupil expenditure for average daily
 
14 attendance for each student enrolled.  Sound instruction shall be
 
15 provided using curriculum materials that are aligned with the
 
16 Hawaii content and performance standards.  Placement of students
 
17 in these educational alternatives shall be at the principal's
 
18 discretion.

 1      SECTION 2.  There is appropriated out of the general
 
 2 revenues of the State of Hawaii the sum of $90,000 or so much
 
 3 thereof as may be necessary for fiscal year 1999-2000 to
 
 4 establish educational alternatives in nine sites across the state
 
 5 for students who are expelled, suspended, or whose presence on
 
 6 campus has been determined to be a disruption or detriment to the
 
 7 educational process.   
 
 8      SECTION 3.  The sum appropriated shall be expended by the
 
 9 department of education for the purposes of this Act.  
 
10      SECTION 4.  This Act shall take effect on July 1, 1999.
