                   A  BILL  FOR  AN  ACT

RELATING TO INVOLUNTARY PSYCHIATRIC TREATMENT.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to require the
 
 2 department of health to convene a task force to study and
 
 3 recommend the process and the requisite criteria by which
 
 4 psychiatric facilities and its authorized medical staff may
 
 5 obtain authorization to involuntarily administer psychoactive
 
 6 medication to involuntarily committed patients who refuse to take
 
 7 prescribed medication, in order to fulfill the facilities' goal
 
 8 of treating the committees while protecting the rights of its
 
 9 patients.
 
10      SECTION 2.  The director of health shall convene a task
 
11 force to study and make recommendations on the process and the
 
12 requisite criteria by which psychiatric facilities and its
 
13 authorized medical staff may obtain authorization to
 
14 involuntarily administer psychoactive medication to persons who
 
15 are involuntarily committed to in-patient psychiatric facilities
 
16 of this State and who refuse to take prescribed psychoactive
 
17 medication.
 
18      SECTION 3.  Members of the task force convened under section
 
19 2 of this Act shall include, but not be limited to, four

 1 representatives of mental health consumers and advocates, office
 
 2 of the public defender, department of the attorney general,
 
 3 department of the prosecuting attorney of one or more counties,
 
 4 the judiciary, Hawaii Psychiatric Medical Association, Hawaii
 
 5 Psychological Association, Hawaii Medical Association, Hawaii
 
 6 Nurses' Association, two members representing protection and
 
 7 advocacy organizations, a social worker, two members of the
 
 8 Senate, and two members of the House of Representatives.
 
 9      SECTION 4.  The task force shall report its findings and
 
10 recommendations to the legislature no later than twenty days
 
11 prior to the convening of the regular session of 2000.
 
12      SECTION 5.  This Act shall take effect upon its approval.
