         Allows  the  department  of  the  attorney  general  to  provide  legal

         Board of Regents.
SB 1299  RELATING TO PROGRAM EXECUTION.                                  HED,FIN
SD 2     Streamlines  the  University  of   Hawaii   operations  by  removing  a
         requirement to  report  each  position  or  fund  transfer in quarterly
         reports to the governor and annual reports to the legislature. 
SB 456   RELATING TO TUITION WAIVERS.                                HED,JHA,FIN
SD 2     Appropriates funds to the office of Hawaiian affairs to offset the cost
         of waiving tuition for  Hawaiian  students  in the University of Hawaii
         system.  States  that  funds  used  for  this  purpose  count as credit
         against the State's liability for ceded land revenue.

         Encourages  and  facilitates  investments  of  capital  and  funds from
         sources outside of Hawaii  by  removing the registration requirement to
         obtain  the   existing   exemptions   from   certain  state  licensing,
         registration and tax laws.

SD 1     Dedicates a portion  of  the  franchise  tax  revenues to the financial

SD 2     Allows an out-of-state bank to establish a de novo interstate branch or
         acquire an interstate branch.  Eliminates five-year age requirement for
         whole bank acquisition by an out-of-state bank.
SB 1145  RELATING TO THE DEPARTMENT OF COMMERCE AND
SD 2     CONSUMER AFFAIRS.                                              CPC, FIN
         Combines certain  special  and  revolving  funds  to  the department of
         commerce  and  consumer   affairs   into  the  department's  compliance
         resolution fund, to  be  managed  at  a  department-wide  level to fund
         department operations.
SB 1261  RELATING TO CAPTIVE INSURANCE.                                 CPC, FIN
SD 1     Authorizes the  insurance  commissioner  to  adopt administrative rules
         establishing fees for captive insurance companies.
SB 1238  RELATING TO PROFESSIONS AND OCCUPATIONS.                       CPC, FIN
SD 2     Transfers responsibility for licensure  and regulation of barbering and
         massage schools from DOE to  DCCA.    Requires  DCCA to assess need for
         regulation and report to the legislature.
SB 20    RELATING TO REAL ESTATE BROKERS AND SALESPERSONS.              CPC, FIN
SD 1     Codifies principal  broker  responsibilities.    Reorganizes continuing
         education provisions into new section.  Directs HAR to work with REC in
         developing legislation on consumer protection and licensing issues.
SB 238   RELATING TO REAL ESTATE BROKERS AND SALESPERSONS.              CPC, FIN
SD 1     Simplifies  the  certification  of  real  estate  continuing  education
         instructors; provides  options  for  licensure  for  candidates  with a
         questionable background;  simplifies  prelicensing broker requirements;
         provides for  an  option  to  the  prelicensing  examination; and makes
         changes to real estate recovery fund.
SB 1131  RELATING TO INSURANCE.                                         CPC, FIN
SD 1     Increases the mandatory insurer contribution  from  $550 to $800 to the
         insurance examiners revolving fund.   Repeals sunset provisions of fund
         and other national association  of insurance commission's accreditation
         requirements.
SB 528   RELATING TO HEALTH INSURANCE.                                  CPC, FIN
SD 2     Exempts health insurance offered  under federally funded programs under
         the Social  Security  Act,  as  amended,  by  insurers,  mutual benefit
         societies, health maintenance  organizations,  and  managed care plans,
         from mandated coverage requirements.
SB 1129  RELATING TO INSURANCE.                                         CPC, FIN
SD 2     Requires continuing education  for  insurance  agents as a prerequisite
         for license renewal; creates insurance licensing administration special
         fund; increases fees.
SB 112   RELATING TO CONDOMINIUM PROPERTY REGIMES.                      CPC, FIN
SD 1     Requires mortgage holders  to  pay  common  expenses to the association
         while foreclosure proceedings are pending,  if the unit is being rented
         pending the foreclosure.

         Allows the department of land and  natural resources to produce a state

         Creates a  special  fund  for  the  board  of  certification to certify
         individuals to operate wastewater treatment plants.

         Defines "recycled water" and "reclaimed  water" as water that by design
         has been treated at a treatment  works and is intended for a beneficial
         purpose.
SB 1429  RELATING TO WASTEWATER TREATMENT FACILITIES.                    EEP,FIN
         Excludes from definition of  public  utility any facility that reclaims
         wastewater  provided  that  the  sole   function  of  the  facility  is
         processing  and  distribution  of  secondary  treated  wastewater,  the
         facility is not processing food  wastes,  and  the not selling water to
         the residential customers.
SB 1024  RELATING TO ENVIRONMENT.                                    EEP,JHA,FIN
         Brings management practices regarding water pollution, domestic sewage,
         etc., under the water pollution  law.    Allows  the DOH to establish a
         permanent exempt position for  an  ecological  risk assessor.  Requires
         the preparation of an EA for actions subject to discretionary approval.
SB 737   RELATING TO NOISE.                                              EEP,JHA
         Exempts small construction projects from the permit requirements of the
         noise pollution law; provided that the department of health is notified
         of the project.
SB 738   RELATING TO NOISE POLLUTION.                                    EEP,JHA
         Shortens the allowable period for  the  permit review process for noise
         pollution permits to 30 days.
SB 798   RELATING TO NOISE.                                              EEP,JHA
         Clarifies jurisdiction regarding noise control.
SB 368   RELATING TO RESIDENTIAL PROPERTY OCCUPANCY.                 EEP,HLT,CPC
         Prohibits the director of health  from issuing an air pollution control
         permit for a  medical  waste  incinerator  or  a  solid waste pollution
         permit for a medical waste  sterilizer  that is located within 500 feet
         of any residential dwelling.
SB 531   RELATING TO ROADSIDE HERBICIDE USE.                        EEP,TRN,FIN 
         Requires state and county  agencies responsible for roadside vegetation
         maintenance  to  develop   and   implement   an  integrated  vegetation
         management  (IVM)  strategy   to   minimize   the   use  of  herbicide.
         Establishes a roadside vegetation committee.

SD 2     Provides that  the  excise  tax  on  cigarettes  shall  be  imposed and
         collected through  the  use  of  stamps  purchased  by  wholesalers and
         dealers, and affixed to cigarette packages.
SB 613   RELATING TO TOBACCO PRODUCTS.                             HLT, CPC, FIN
SD 2     Creates statewide licensure  mechanism  for  retail  tobacco sales that
         provides   for  licensing  retail  tobacco    vendors,  inspections and
         enforcement,  adjudication  of   fines   and  penalties,  training  and
         education for retail  merchants  and  public  awareness  of the State's
         statute governing the sale of tobacco  to minors.
SB 1034  RELATING TO THE HAWAII TOBACCO SETTLEMENT
SD 1     SPECIAL FUND.                                                  HLT, FIN
         Creates a special fund for  tobacco settlement moneys, a Hawaii tobacco
         prevention and control endowment fund, and a rainy day fund.
SB 1231  RELATING TO SMOKING IN THE WORKPLACE.                     HLT, LAB, JHA
SD 3     Prohibits smoking in workplaces  employing  2  or more employees.  This
         prohibition does not apply  to  the  dining areas of restaurants, bars,
         and hotel guest rooms.
SB 511   RELATING TO HEALTH CARE FACILITY PAYMENTS.                HLT, CPC, FIN
SD 1     Requires insurers, mutual  benefit  societies,  and  HMOs  to pay rural
         health  care  facilities  directly  regardless  of  their participatory
         status.
SB 860   RELATING TO MENTAL HEALTH.                                HLT, CPC, FIN
         Adds marriage and family therapists  for  purposes of mental health and
         alcohol and drug abuse treatment insurance benefits.
SB 844   RELATING TO HEALTH INSURANCE.                             HLT, CPC, FIN
SD 2     Requires health  insurers  to  equitably  reimburse  for mental health,
         alcohol, and drug treatment.
SB 1032  RELATING TO INVOLUNTARY PSYCHIATRIC TREATMENT.            HLT, JHA, FIN
SD 1     Authorizes  the   adoption   of   administrative   rules   allowing  an
         interdisciplinary  panel  of   mental   health   clinicians  to  review
         applications by the  department  of  health for involuntary psychiatric
         treatment  with  medication  for  patients  at  in-patient  psychiatric
         facilities.

SB 1452  RELATING TO HEALTH.                                       HLT, CPC, FIN
         Establishes the health insurance revolving fund. Requires the insurance
         commissioner to conduct  public  education  programs about managed care
         plans. Clarifies  duties  of  HMOs  and  health  insurers for emergency
         medical conditions.   Allows  the  insurance  commissioner to conduct a
         review hearing of HMO patient complaints, etc.
SB 1127  RELATING TO INSURANCE.                                    HLT, CPC, FIN
SD 1     Establishes the health insurance revolving fund. Authorizes assessments
         against mutual benefit societies and HMOs  to be credited to the health
         insurance revolving fund and motor vehicle insurance revolving fund.
SB 1128  RELATING TO INSURANCE.                                    HLT, CPC, FIN
SD 2     Clarifies and  improves  laws  regulating  insurance,  including mutual
         benefits  societies  and  health  maintenance  organizations. Increases
         fines for insurance law violations.
SB 1130  RELATING TO HEALTH MAINTENANCE ORGANIZATIONS.             HLT, CPC, FIN
SD 1     Amends the provisions governing fees  for certificates of authority for
         health maintenance organizations.
SB 1136  RELATING TO REGULATION OF OSTEOPATHY.                     HLT, CPC, FIN
SD 2     Abolishes the Board of  Osteopathic  Examiners and transfers regulatory
         functions to the Board of Medical  Examiners.  Requires four members of
         the  Board  of  Medical  Examiners  to  be  osteopathic  physicians  or
         surgeons.

         Transfers the  administration  and  supervision  of  the school-to-work
         opportunities   pilot   project    from   the   Hawaii   school-to-work
         opportunities executive council to the  DOE.   Makes the Hawaii school-
         to-work opportunities executive council an advisory body to the BOE and
         the DOE.
