HSCR 330      Exempts county real property  appraisers  from law regulating real

HB 1142 HD2   RELATING TO ENVIRONMENT.
HSCR 576      Places certification of cesspool pumping firms with the Department
              of Health.  Subjects knowing  violations of rules regarding spills
              and  dumping  to  criminal  penalties.  Allows  officials  of  the
              Department  of  Health  to  obtain  search  warrants  for criminal
              violations.   Provides  consistent  penalties  for  wastewater and
              sludge spills  and  dumping.    Makes  explicit  the Department of
              Health's authority to deal with recycled water.  Defines "recycled
              water" to mean treated  wastewater  that  by design is intended or

HB 1014 HD1   RELATING TO TOURISM.
HSCR 236      Sunsets the Hawaii Convention  Center  Authority on an unspecified
              date;  assigns  responsibility  to  market,  operate,  manage, and
              maintain the  Hawaii  convention  center  facility  to  the Hawaii
              Tourism Authority; transfers the  balance of the Hawaii Convention
              Center Capital and Operations Special Funds to the Tourism Special
              Fund; assigns the funding responsibility for the convention center
              debt service  and  operating  requirements  to  the Hawaii Tourism
              Authority. (TSM,FIN)
HB 72 HD1     RELATING TO ELECTIONS.
HSCR 523      Provides that candidates who  voluntarily  agree to limit campaign
              expenditures and become eligible for  matching funds must do so at
              or before  the  time  of  filing  nomination  papers  and  may not
              thereafter withdraw their agreement.   Allows unopposed candidates
              to apply for matching funds.  Extends the time within contributors
              must be notified that a  candidate has exceeded expenditure limits
              to  30  days.    Allows  candidates  who  have  exceeded  spending
              limitations by no more than 1% to return 25% of, as opposed to all
              matching  funds.    Reduces  the  time  that  qualifying  campaign
              contribution statements must be filed  with the commission from 60
              to 30 days. (JHA,FIN)
HB 1237 HD1   RELATING TO FIREWORKS.
HSCR 536      Allows the  counties  to  regulate  the  use  of non-aerial common
              fireworks through the issuance of certificates of use. (JHA,FIN)
HB 1675       RELATING TO HAWAIIAN HOME LANDS TRUST INDIVIDUAL CLAIMS.
HSCR 542      Extends the time  to  process  individual Hawaiian homelands trust

              Defines  "industrial  hemp".    Authorizes  the  State  to   allow
              privately-funded industrial  hemp  research  to  be   conducted in
              Hawaii when  the  State  department  of  public    safety issues a
              controlled substance registration,  and    the  U.S. Department of
              Justice, Drug  Enforcement    Administration,  issues a federally-
              controlled substance  registration  for  research on the agronomic
              potential of    industrial  hemp.    Authorizes  the department of
              public    safety,  in   cooperation   with  the  Drug  Enforcement
              Administration, to monitor all phases of the research.   Specifies
              that all agronomic data derived from  research  under this bill be
              deemed to be proprietary in nature   and not subject to disclosure
              pursuant to the uniform  information practices act.

              Extends first term  of  3  members  on elections appointment panel
              from 4 to 6 years who will be selected by the governor.

              Grants property owners immunity from civil liability incurred when
              a person is  injured  on  the  owner's  land  while  engaging in a
              "recreational purpose" on  private  land  or on a government-owned
              trail or access.

              Toughens Hawaii's criminal laws for perpetrators of child abuse.
HB 1528 HD1   RELATING TO PENALTIES AND PROCEDURES ON ARREST.            TRN,JHA
              Authorizes police to arrest drivers stopped for traffic violations
              who refuse to provide  proof  of  their  identification or who are
              suspected of providing false or misleading information.
HB 1007       RELATING TO FIREARMS.                                          JHA
              Amends the penalty provisions of  the firearms law to clarify that
              the penalty for a violation of  this  section is intended to be in
              addition to and not in  lieu  of  the penalty for other applicable
              offenses.
HB 1529       RELATING TO ROBBERY.                                           JHA
              Defines the elements that constitute robbery offenses.
HB 1004       RELATING TO HOMICIDE.                                          JHA
              Proposes to:  (1)  revise  the  statutory  elements of murder; (2)
              create a new version of  murder  in  the second degree; (3) revise
              the extreme mental or  emotional  disturbance  defense to one that
              reduces the level of offense just one level.
HB 123 HD1    RELATING TO DRIVING UNDER THE INFLUENCE OF                 TRN,JHA
              INTOXICATING LIQUOR.
              Subjects motor vehicles driven at the time of a 3rd DUI offense or
              an  offense  of   habitually   driving   under  the  influence  of
              intoxicating liquor or drugs to forfeiture law.

              Amends driving impaired  statutes  to  consolidate and conform the
              time of the  alleged  violation  offenses  relating to operating a
              vehicle while using an intoxicant.  Makes conforming amendments.

              SURVEILLANCE.
              Conforms state  wiretapping  and  electronic  surveillance  law to
              federal law.
HB 848 HD1    RELATING TO SUBSTANCE ABUSE TESTING.                       LAB,JHA
              Provides for the use  of  substance  abuse on-site screening tests
              (i.e., portable substance abuse  tests) that meet the requirements
              of the United States  Food  and Drug Administration for commercial
              distribution.
HB 351 HD1    RELATING TO PRIVACY OF HEALTH CARE                     HLT,CPC,JHA
              INFORMATION.
              Protects privacy of  health  care  information  by stipulating for
              conditions under which  information  can  be  disclosed.  Provides
              penalties.
HB 530 HD1    RELATING TO EMPLOYMENT DISCRIMINATION.                     LAB,JHA
              Makes it an unlawful  discriminatory  practice  for an employer to
              condition employment or hiring  upon the employee's relinquishment
              of the right to  initiate  or  participate  in an investigation or
              proceeding under  chapter  368,  HRS,  or  any  other  right under
              chapters 368 or 378, HRS.

              attorneys' fee from being awarded against the State and counties.

              Adopts a  comprehensive,  modified  uniform  health-care decisions
              under  no  duress,  fraud,  or  undue  act  which  would  permit a
              competent individual to control  decisions  relating to his or her
              own medical care. Establishes  a  task force to review end-of-life
              care.
HB 1378 HD1   RELATING TO HISTORIC PRESERVATION.                         WLU,JHA
              Amends the historic preservation law  to provide that counties may
              approve uses of  historic  properties  that comply with applicable
              zoning requirements.

              Clarifies that the  penalty  applied  to employers for unjustified
              wage withholding will be equal  to  the amount of unpaid wages and
              interest at a rate of  six  per  cent  per  year from the date the
              wages were due.
HB 162        RELATING TO PUBLIC SERVICE.                                LMG,JHA
              Clarifies the scope of  the  subpoena powers of legislative bodies
              by removing statutory  references  to  repealed  Chapter 85 of the
              Hawaii Revised Statutes.
HB 67         RELATING TO CIVIL JUSTICE REFORM.                              JHA
              Limits recovery for  all  noneconomic  damages  in tort actions to
              $500,000.  Codifies court  rule  relating  to offers of judgement.
              Requires payment of reasonable attorneys's fees and court costs to
              encourage pretrial settlements.  Limits punitive damages awards.
