S.B. 813 RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUECPN

S.D. 1   BONDS TO ASSIST THE GAS UTILITY IN SERVING THE GENERAL
        PUBLIC.
        Authorizes the issuance of special purpose revenue
        bonds up to $19,600,000 to assist the gas utility in
        providing utility gas services to the general public;
        authorizes the issuance of refunding special purpose
        revenue bonds; including times subsequent to December
        31, 2002.

S.B. 1102  RELATING TO THE PUBLIC EMPLOYEES HEALTH FUND CPN,WAM
S.D. 1   Removes the responsibility for funding the annual
        audit of the Fund from the state comptroller and makes
        it the responsibility of the Fund.

S.B. 1124  RELATING TO THE CODE OF FINANCIAL INSTITUTIONS CPN,WAM
S.D. 1   Allows an out-of-state band to establish a de novo
        interstate branch or acquire an interstate branch.
        Specifies that the costs for the audit shall be paid
        out of the Public Employees' Health Fund's reserves.

S.B. 1126  RELATING TO HAWAII HURRICANE RELIEF FUND BONDS CPN,WAM
        This bill extends the authorization to issue
        reimbursable general obligation bonds for the purposes
        of the Hawaii Hurricane Relief Fund.

S.B. 1128  RELATING TO INSURANCE                       CPN,WAM
S.D. 1   Increases fines for insurance law violations from a
        range of $10 to $1000 per violation to a range of $100
        to $10,000 per violation.  Conforms health care
        coverage disclosure requirements for mutual benefit
        societies and HMOs to the requirements for insurers.
        Clarifies that fraternal benefit society agents are
        licensed under the solicitor licensing provisions.

S.B. 1130  RELATING TO HEALTH MAINTENANCE ORGANIZATIONS CPN,WAM
        Requires HMO's to file quarterly reports with the Ins.
        Comm. Adds a penalty provision for failure by an HMO
        to timely pay the renewal fee for its certificate of
        authority.

        Increases the mandatory insurer contribution from $500
        to $800 to the insurance Examiners Revolving fund and
        removes the sunset date for the Fund and certain NAIC

        Provides DCCA with greater flexibility in the
        management of its funds to support its goal of fiscal
        self-sufficiency by allowing DCCA to consolidate
        various funds into the Compliance Resolution Fund.

        Authorizes the insurance commissioner to adopt
        administrative rules establishing fees for captive
        insurance companies.

        Establishes the USF as a separate fund outside the
        State treasury; exempts the USF from administrative
        surcharges; provides for repayment of moneys loaned to

        USF; and appropriates $300,000 from USF for the
        universal service program.

        contract for more than one type of benefit plan for
        medical, drug, vision, and dental benefits.

        Provides retirement benefits for the Trustees of the
        Office of Hawaiian Affairs.

S.B. 1326  RELATING TO LENDER EXEMPTIONS               CPN,WAM
        Encourages and facilitates investments of capital and
        funds from sources outside of Hawaii by removing the
        registration requirement to obtain the existing
        exemptions from certain state licensing, registration
        and tax laws.

        Creates health insurance revolving fund; requires
        insurance commissioner to conduct pubic education
        program about managed care plans; clarifies duties of

        review hearing of HMO patient complaints, etc.

S.D. 1   Provides agricultural loans to qualified farmers who
        export crops and livestock; allows working capital
        loans for farmers affected by State eradication

        PILOT PROJECT AND APPROPRIATING FUNDS TO SUPPORT THE

        benchmarking pilot project and $50,000 to the Hawaii
        community Services Council for technical support for

S.D. 1   Expands responsibilities of the Stadium Authority to
        include the Kapolei Recreational Sports complex;

S.D. 1   INVESTMENT ATTRACTION.
        Appropriates unspecified amount to the hawaii
        strategic development corporation revolving fund;
        restricts HSDC investments to those with at least
        matching private investment; allocates unspecified
        amount to develop a plan to further develop venture
        capital in Hawaii.

        Provides for reforestation and maintenance of timber
        harvest areas on state lands; enhanced management of

S.D. 1   Extends the sunset date for the hawaii teacher
        standards board and the law providing for the issuance
        of certificates to teachers who are not required to
        obtain a license or credential from the teacher
        standards board to June 30, 2010; provides staggered
        terms for new members.

S.B. 106 RELATING TO GOVERNMENT SERVICES         EDU/LRE,WAM
S.D. 1   Requires the school-to-work executive council to
        establish a clear mission statement, specific goals of
        the program, methods of appraising outcomes, methods
        to control expenditures; to require proper
        implementation of Act 343, SLH 1997; and to determine
        the effectiveness of safety studies.

S.B. 119 RELATING TO SCHOOL REPAIRS, MAINTENANCE, AND
S.D. 1   IMPROVEMENTS                                EDU,WAM
        Increases the school-level minor repair and
        maintenance accounts form $8,000 to $20,000 per
        school; allows principals to hire the department of
        accounting and general services to perform these
        services; allows these school-level accounts to be
        used for minor improvements.

S.B. 185 RELATING TO EDUCATION                       EDU,WAM
        Establishes the Hawaii state student council, with
        student representatives from each departmental school
        district; requires the council to conduct an annual
        conference of secondary students; and requires the
        council to determine whether to select the student
        member of the BOE or to run an election to select the
        individual.

        Allows state agency heads to purchase computer and
        communication systems with proceeds from the sale of

S.D. 1   Removes auditor from responsibility for DOE fiscal

S.D. 1   Authorizes the University of Hawaii and the Department

S.B. 1011  RELATING TO THE STATE FOUNDATION ON CULTURE AND EDU,WA

        THE ARTS
        Amends the law relating to the SFCA by clarifying the
        roles of the commission, executive director, and
        foundation staff.  Specifies that agencies receiving

 
        capital improvement appropriations are responsible for
        calculating the 1% due to the works of art special
        fund.  Adds remedies for noncompliance.

        positions and to establish temporary positions for

        Grants the BOE the authority to establish a fee of not
        more than $10 to be added to delinquent patron
        accounts at the time they are referred to a collection
        agency.

S.D. 1   Allows the Board of Education to appoint the State
        Librarian without regard to state residency provisions
        and for a term of up to 4 years.  Allows the Board of

        without a cap until July 1, 2004.

        Superintendent of Education for five years.

        new schools and requires the DOE to study the issue of
        paying athletic coaches salary in the same manner as
        other teachers.

S.D. 1   Requires the state librarian to include in annual
        reports on the status of the libraries special fund
        and the fee for enhanced services special fund,
        financial information, actual expenditures of receipts
        by individual libraries, and expenditure allotment by
        individual libraries.

        Requires the auditor to contract with an independent
        auditing firm to conduct an annual financial audit of
        state and county governments to evaluate efficiency in
        operations and effectiveness in spending, and to
        determine where cutbacks in state and county funding

S.D. 1   Clarifies the powers of the boards of directors of
        associations of apartment owners to enter into
        purchase agreements with lessors in order to
        facilitate and encourage voluntary lease-to-fee
        conversions of condominium projects.

        Amends Act 230, SLH 1998, to: require the committee to
        transform the State's accounting procurement and
        budgeting systems, and the managed process committee,
        to annually report to legislature; establish specific
        duties for the managed process committee; specify
        further duties of the managed process committee; and
        delete the sunset date.

S.D. 1   Reduces the cost of copying government records form 50
        cents to 6 cents.

S.D. 1   Establishes a fair market value standard (FMVS) for
        appraising the leased fee interest of condo and co-op
        housing corp. for leases that do not specify an
        appraisal standard and for leases on or after

 
        effective date of this Act; allows FMVS if lessor and
        lessee agree for leases prior to date of this Act.

        Penalizes contractors on a public contract who do not
        pay a subcontractor within 10 days of job completion
        by establishing fines and debarment from bidding on
        future public contracts.

        hospital representatives to cooperatively develop
        protocols for presenting the option to donate. (3)
        Prohibits family members from overriding the donor's
        wishes when evidenced by a document of gift. (4)
        Limits liability of any person who relies in good
        faith on the document of gift, except for gross
        negligence, recklessness, or intentional misconduct.

        waterfront, has been successful.  The continuation of
        this practice is necessary for the timely
        redevelopment of the waterfront.  Section 18 of the
        Act will automatically repeal Section 5 on June 30,
        2000.
