         DECISION MAKING ON THE FOLLOWING BILLS
            (Deferred from February 12, 1999)


SB 145     RELATING TO ANATOMICAL GIFTS                   HHS/JDC,WAM
           Amends Hawaii's  Uniform  Anatomical  Gift  Act to:
           (1) Require all acute  care  hospitals in Hawaii at
           or near  the  time  of  every  individual death, to
           report to the  organ procurement organization (OPO)
           by telephone  to  determine  suitability  for organ
           donation  of  the  individual  in  question.    (2)
           Require  OPO   and   hospital   representatives  to
           cooperatively develop protocols  for presenting the
           option to donate.  (3) Prohibit family members from
           overriding the donor's  wishes  when evidenced by a
           document of  gift.    (4)  Limit  liability  of any
           person who relies in good  faith on the document of
           gift, except for gross negligence, recklessness, or
           intentional misconduct.   (5)  Require  the OPO and
           hospital representatives to conduct an annual death
           record review.  (6)  Authorize  the assessment of a
           fine for  noncompliance.    (7)  Establish  a state
           organ donation advisory  committee.   (8) Authorize
           the Lt. Governor to actively promote organ, tissue,
           and other anatomical gift efforts.

SB 177     RELATING TO FAMILIES                           HHS/JDC,WAM
           Protects children and youth from abuse and neglect.

SB 601     RELATING TO SUBSTANCE ABUSE                    HHS/JDC,WAM
           Establishes a substance abuse policy council within
           the office  of  the  governor  to develop statewide
           policy   regarding   education,   prevention,   and
           treatment programs.

SB 1058    RELATING TO RECOVERY OF MEDICAL                HHS/JDC,WAM
           PAYMENTS
           Amends section 346-37,  Hawaii Revised Statutes, to
           clarify and  standardize  the  provisions regarding
           the reimbursement rights of the Department of Human
           Services (DHS) in third-party liability situations;
           clarifies  that  in  liability  situations,  DHS is
           given the discretion  to  settle  or compromise the
           amount of its  reimbursement rights; clarifies that
           lien and reimbursement disputes  are to be resolved
           through the administrative  hearing process; allows
           service of liens by certified mail.
 
SB 1020    RELATING TO EPIDEMIOLOGIC                      HHS/JDC,WAM
           INVESTIGATIONS
           Requires   health   care   providers   and  medical
           facilities   to    provide    limited   diagnostic,
           treatment, and contact  information  for  use in an
           epidemiologic  disease  and  injury  investigations
           upon request by an authorized representative of the
           Director of Health; protects the confidentiality of
           this information; exempts  providers and facilities
           from liability for furnishing this information.
