Sir:

     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred S.B. No. 456, S.D. 2, entitled: 

     "A BILL FOR AN ACT RELATING TO TUITION WAIVERS,"

begs leave to report as follows:

     The purpose of this bill is to appropriate funds to the
Office of Hawaiian Affairs (OHA) to provide tuition waivers to
Hawaiian students at the University of Hawaii (UH).  Funds
appropriated shall be credited against the State's obligation to
pay OHA a pro rata share of ceded land revenues.

     Testimony in support of this bill was received by the
University of Hawaii and several private citizens.  Additional
testimony in support of this bill with amendments was received
from the Office of Hawaiian Affairs, University of Hawaii Center
for Hawaiian Studies, and several private citizens.

     Additional comments on this measure were received from
several private citizens.  Your Committee was also provided with
a copy of a petition in support of granting tuition waivers to
native Hawaiian students.

     Your Committee recognizes the special relationship that the
Hawaiian people have with the State of Hawaii.  As such, your
Committee supports the concept of tuition waivers as an important
means of providing access to post-secondary education for
Hawaiians.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of S.B. No. 456, S.D. 2, and recommends that it be
referred to the Committee on Finance.
