Sir:

     Your Committee on Energy and Environmental Protection, to
which was referred S.B. No. 207 entitled: 

     "A BILL FOR AN ACT RELATING TO WASTEWATER,"

begs leave to report as follows:

     The purpose of this bill is to provide the Board of
Certification of Operating Personnel in Wastewater Treatment
Facilities (Board) with the necessary funds to carry out its
responsibilities to certify individuals to operate wastewater
treatment plants.

     This bill creates a Board of Certification Special Fund into
which would be deposited registration and certification fees
generated by the Board's operator certification program.  This
would enable the operational costs of the Board to be adequately
funded by its own revenues.

     The Board and the County of Kauai Department of Public Works
testified in support of this measure.  The Department of Health
also supported this bill, provided that passage of this measure
does not affect its proposed Executive Budget request.

     Your Committee has amended Section 340B-11, Hawaii Revised
Statutes, to make it consistent with the provisions of this bill.

     As affirmed by the record of votes of the members of your
Committee on Energy and Environmental Protection that is attached
to this report, your Committee is in accord with the intent and
purpose of S.B. No. 207, as amended herein, and recommends that
it pass Second Reading in the form attached hereto as S.B. No.
207, H.D. 1, and be referred to the Committee on Finance.
