Sir:

     Your Committee on Finance, to which was referred S.B. No.
1274, H.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO PUBLIC SAFETY,"

begs leave to report as follows:

     The purpose of this bill is to address a variety of public
safety issues by:

     (1)  Transferring the responsibility of the administration
          of the night security program for selected public
          schools from the Department of Public Safety to the
          Department of Education;

     (2)  Authorizing the Governor to proceed with the
          development of privately-developed in-state
          correctional facilities or an in-state correctional
          facility using public or private funds, subject to the
          developer obtaining a certificate of participation if
          private funds are used;

     (3)  Continuing the comprehensive schedule of alternatives
          to incarceration established by Act 25, Special Session
          Laws of Hawaii 1995 (SSLH); and

     (4)  Continuing the rehabilitative and assistance programs
          for arrestees and incarcerated persons established by
          Act 25, SSLH 1995.

     The Department of Budget and Finance testified in opposition
to this bill.  The Department of Education submitted comments on
this bill.

     As affirmed by the record of votes of the members of your
Committee on Finance that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No.
1274, H.D. 1, and recommends that it pass Third Reading.
