Sir:

     Your Committee on Judiciary, to which was referred S.B. No.
1163 entitled: 

     "A BILL FOR AN ACT RELATING TO THE RELEASE OF PRE-TRIAL
     INMATES,"

begs leave to report as follows:

     The purpose of this bill is to extend the authority to grant
emergency release of pre-trial inmates until June 30, 2000.

     Your Committee finds that because of overcrowding in
correctional facilities, the Department of Public Safety needs a
release mechanism by which it can relieve overcrowding in the
pretrial population while considering public safety.  Your
Committee further finds that in 1998 the Legislature established
strict controls over which defendants qualify for emergency
pretrial release.

     Testimony in support of this measure was received from the
Department of Public Safety.  Testimony in opposition to this
measure was received from the Department of the Prosecuting
Attorney for the City and County of Honolulu.

     As affirmed by the record of votes of the members of your
Committee on Judiciary that is attached to this report, your
Committee is in accord with the intent and purpose of S.B. No.
1163 and recommends that it pass Second Reading and be referred
to the Committee on Ways and Means.
