Sir:

     Your Committee on Water, Land, and Hawaiian Affairs, to
which was referred S.B. No. 1098 entitled: 

     "A BILL FOR AN ACT RELATING TO THE STATE WATER CODE,"

begs leave to report as follows:

     The purpose of this measure is to amend the state water
code, chapter 174C, Hawaii Revised Statutes (HRS), to correct
unintentional reference errors, to provide consistency in
referencing governmental agencies, and to clarify language
throughout.

     Testimony in support of this measure was received from the
Department of Land and Natural Resources and Land Use Research
Foundation of Hawaii.  The Department of Water Supply of the
County of Maui submitted suggested amendments to this measure.

     Your Committee finds that the state water code references
the Board of Land and Natural Resources as an authority regarding
a matter when the Commission on Water Resource Management is the
intended and actual authority.  This measure corrects this error
as well as other errors of terminology and consistency.

     As affirmed by the record of votes of the members of your
Committee on Water, Land, and Hawaiian Affairs that is attached
to this report, your Committee is in accord with the intent and
purpose of S.B. No. 1098 and recommends that it pass Second
Reading and be placed on the calendar for Third Reading.
