Sir:

     Your Committee on Water and Land Use, to which was referred
H.B. No. 368 entitled: 

     "A BILL FOR AN ACT RELATING TO THE STATE WATER CODE,"

begs leave to report as follows:

     The purpose of this bill is to provide the Board of
Agriculture with the same authority over the water it purveys as
the county water agencies exercise over the water that they
purvey. 

     Your Committee received testimony in support of this bill
from the Board of Agriculture, the Commission on Water Resource
Management, and the Hawaii Farm Bureau Federation.  

     Your Committee finds that the authority of the Board of
Agriculture over the water that it purveys should be comparable
to the authority exercised by the county water agencies over
water for municipal purposes.  

     As affirmed by the record of votes of the members of your
Committee on Water and Land Use that is attached to this report,
your Committee is in accord with the intent and purpose of H.B.
No. 368 and recommends that it pass Third Reading.
