Sir:

     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred H.B. No. 1 entitled: 

     "A BILL FOR AN ACT RELATING TO CHILD PASSENGER SAFETY,"

begs leave to report as follows:

     The purpose of this bill is to increase the safety of
children riding as passengers in motor vehicles.

     Testimony in support of this bill was received from the
State Department of Health, Department of Transportation, Hawaii
Insurers Council, State Farm Insurance Companies, Mothers Against
Drunk Driving, and Keiki Injury Prevention Coalition.

     Your Committee finds that the use of seat belts is an unsafe
practice for some children between the ages of three and four due
to their small size.  

     Your Committee has amended this bill by:

     (1)  Allowing children between the ages of three and four
          who weigh in excess of 40 pounds to be restrained by a
          seat belt assembly while riding as passengers in a
          motor vehicle operated on a public highway; 

     (2)  Revising the findings and purpose section; and

     (3)  Making technical, nonsubstantive amendments for
          purposes of style and clarity.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 1, as amended herein, and recommends that it
pass Third Reading in the form attached hereto as H.B. No. 1,
H.D. 1.
