Sir:

     Your Committee on Labor and Public Employment, to which was
referred H.B. No. 1163 entitled: 

     "A BILL FOR AN ACT RELATING TO CIVIL RIGHTS,"

begs leave to report as follows:

     The purpose of this bill is to prohibit discriminatory
practices in real property transactions and public accommodations
on the basis of sexual orientation.

     The Hawaii Civil Rights Commission, the Hawaii State
Commission on the Status of Women, the National Employment
Lawyers Association, the American Friends Service Committee, the
League of Women Voters in Hawaii, and a member of the public
supported this measure.

     Your Committee finds that currently sexual orientation is
prohibited only with regard to employment discrimination.
However, your Committee recognizes that a person's ability to
secure food, shelter, and other life necessities should also not
be limited because of their sexual orientation.

     Your Committee further finds that the Hawaii Civil Rights
Commission has had to reject complaints alleging sexual
orientation discrimination in housing and public accommodations
because there is no remedy under state law.  This measure extends
protection against sexual orientation discrimination to cover
state housing and public accommodations laws.

     Your Committee has amended this measure by making technical,
nonsubstantive amendments for purposes of style, clarity, and
consistency.

     As affirmed by the record of votes of the members of your
Committee on Labor and Public Employment that is attached to this
report, your Committee is in accord with the intent and purpose
of H.B. No. 1163, as amended herein, and recommends that it pass
Second Reading in the form attached hereto as H.B. No. 1163, H.D.
1, and be referred to the Committee on Judiciary and Hawaiian
Affairs.
