                                   RE: H.B. No. 10

Honorable Norman Mizuguchi
President of the Senate
Twentieth State Legislature
Regular Session of 1999
State of Hawaii

Sir:

Your Committee on Transportation and Intergovernmental
Affairs, to which was referred H.B. No. 10 entitled:

"A BILL FOR AN ACT RELATING TO MOTOR VEHICLES,"

begs leave to report as follows:

The purpose of this measure is to require employers to
provide a driver improvement program for the drivers of
commercial motor vehicles with a gross vehicle weight rating in
excess of ten thousand pounds.

Testimony in support of this measure was received from the
Department of Transportation and Hawaii Transportation
Association.

Your Committee finds that federal motor carrier safety
regulations require that a driver must be able, by reason of
experience, training, or both, to safely operate the type of
commercial motor vehicle being driven. Currently, state law
requires employers to provide a driver improvement program (DIP)
for commercial motor vehicle drivers. The DIP provides a system
for continuous driver evaluation and annual driver safety
courses. However, state law is inconsistent with the federal
regulations in identifying which commercial motor vehicle drivers
are required to be provided with the training. This measure
makes Hawaii law consistent with federal regulations.

As affirmed by the record of votes of the members of your
Committee on Transportation and Intergovernmental Affairs that is

a HB10
                                   STAND. COM. REP. NO. 1536

attached to this report, your Committee is in accord with the
intent and purpose of H.B. No. 10 and recommends that it pass
Second Reading and be placed on the calendar for Third Reading.

                                   Respectfully submitted on
behalf of the members of the
                                   Committee on Transportation
                                   and Intergovernmental Affairs,

                                   ______________________________
