Sir:

     Your Committee on Commerce and Consumer Protection, to which
was referred H.B. No. 1034 entitled: 

     "A BILL FOR AN ACT RELATING TO MOTOR CARRIERS,"

begs leave to report as follows:

     The purpose of this measure is to enable the Public
Utilities Commission, in its discretion, to grant temporary
authority to a common or contract motor carrier to provide
transportation services when an urgent need arises.

     The Public Utilities Commission and the Consumer Advocate
presented testimony in favor of the measure.  

     Your Committee finds that under existing law, prior to the
granting of a temporary authority to provide transportation
services by the Public Utilities Commission, an applicant must
first provide proof that the application has first been served
upon every current holder of a certificate of public convenience
and necessity within the classification for which the temporary
authority is being applied.

     Your Committee believes that this measure will enable the
Public Utilities Commission to respond more quickly to the
transportation needs of areas affected by natural disasters or
when other emergency transportation needs exist.

     As affirmed by the record of votes of the members of your
Committee on Commerce and Consumer Protection that is attached to

this report, your Committee is in accord with the intent and
purpose of H.B. No. 1034 and recommends that it pass Second
Reading and be placed on the calendar for Third Reading.
