Sir:

     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred H.B. No. 102, H.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO WAGE PAYMENTS,"

begs leave to report as follows:

     The purpose of this bill is to eliminate the ambiguity in
penalties assessed against employers who fail to timely pay wages
by establishing that the penalties assessed shall be in amounts
equal to unpaid wages.

     Testimony in support of this bill was received from the
State Department of Labor and Industrial Relations, Consumer
Lawyers of Hawaii, and the National Employment Lawyers
Association.

     Your Committee finds that the provisions of this bill will
promote the fair and equitable resolution of disputes arising
under Chapter 388, Hawaii Revised Statutes.

     Your Committee has amended this bill by making a technical,
nonsubstantive amendment for the purpose of correcting a drafting
error.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 102, H.D. 1, as amended herein, and

recommends that it pass Third Reading in the form attached hereto
as H.B. No. 102, H.D. 2.
