Sir:

     Your Committee on Labor and Public Employment, to which was
referred H.B. No. 102 entitled: 

     "A BILL FOR AN ACT RELATING TO WAGE PAYMENTS,"

begs leave to report as follows:

     The purpose of this bill is to eliminate discretion in the
amount of penalty assessed against an employer who fails to pay
wages in a timely manner.

     The Department of Labor and Industrial Relations submitted
testimony in support of this measure.  The National Employment
Lawyers Association and Consumer Lawyers of Hawaii submitted
testimony in support of this measure, both requesting that the
measure be amended to apply to pending cases.

     Your Committee has amended this measure by making technical,
nonsubstantive amendments for purposes of style and clarity.

     As affirmed by the record of votes of the members of your
Committee on Labor and Public Employment that is attached to this
report, your Committee is in accord with the intent and purpose
of H.B. No. 102, as amended herein, and recommends that it pass
Second Reading in the form attached hereto as H.B. No. 102, H.D.
1, and be referred to the Committee on Judiciary and Hawaiian
