RELATING TO ELECTIONS.

Prohibits candidates for public office from appearing in public service announcements from the time of filing nomination papers until the time the person is no longer a candidate.

RELATING TO THE PRIMARY ELECTION DATE.

Moves the date of the primary election from the second to the last Saturday in September to the second Saturday in August of every even numbered year.

RELATING TO ESCROW DEPOSITORIES.

Revises the escrow depository law to:  (1)  clarify which escrow transactions are covered by the statute and which are not;  (2)  update the statute to adequately reflect the present day size of the transactions routinely handled by the industry;  (3)  provide for more flexibility in supervising and regulating the industry;  and  (4)  ensure adequate protection for the consumer.

RELATING TO PROCUREMENT.

Contracts less than $5,000,000 between a governmental body and professional architects, landscape architects, engineers, and surveyors, shall not require defense of a governmental body; contracts may require indemnification and holding harmless of the governmental body.  (SD1)

RELATING TO THE HAWAII RULES OF EVIDENCE.

Provides that if evidence of an alleged victim's character for aggressiveness or violence is offered by an accused and admitted under rule 404(a)(2), evidence of the same trait of character of the accused offered by the prosecution may be admissible.

RELATING TO INFORMATION CHARGING.

Adds Methamphetamine trafficking in the second degree to those class B felonies that may be initiated by information charging.  Provides that all class C felony offenses for failure to comply with covered offender registration requirements may be initiated by information charging.

RELATING TO CHAPTER 844D, HAWAII REVISED STATUTES.

Increases the crime of refusing to provide a DNA buccal swab sample from a misdemeanor to a Class C felony.  Provides for the use of "reasonable force" in obtaining DNA buccal swab samples from felons who refuse to comply with the law.  Eliminates the 20 working day or 5 calendar day periods allowed for the collection of DNA buccal swab samples from felons subject to collection.

RELATING TO CONTEMPT OF COURT.

Facilitates the enforcement of an order compelling a parent to pay child support, medical support, or other remedial care for his or her child, by providing that proof that the parent was present in court at the time the order was pronounced or that parent was served with said order, and proof that the parent did not comply with said order, constitutes prima facie evidence of a civil contempt of court.

RELATING TO THE PENAL CODE.

Amends the offenses of Murder in the First Degree, Murder in the Second Degree, Assault in the Second Degree, and Terroristic Threatening in the First Degree to include conduct committed against victims who the courts and police are attempting to keep safe with protective orders.

RELATING TO SENTENCING.

Restores a statutory provision which allows presentence mental or medical examinations of defendants for purposes of sentencing.

RELATING TO SENTENCING OF REPEAT OFFENDERS.

Specifies that any person committing felony insurance fraud in motor vehicle insurance, private health insurance, mutual benefit health insurance, health maintenance organization health insurance, and worker's compensation insurance lines will be subject to repeat offender increased sentencing guidelines if that person has a pervious conviction for the crime of felony insurance fraud.  (SD1)

RELATING TO DRUGS.

Increases the penalties for intent to manufacture a controlled substance with knowledge that a child is present in the structure where the offense occurs.

Repeals obsolete language relating to the crime of promoting a dangerous drug in the second degree.

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted, the date and time of the hearing, and the number of copies needed for submittal.

 

·         By Email:  Testimony may be emailed if less than 5 pages in length, to the Legislature's Public Access Room at testimony@capitol.hawaii.gov.  Please indicate to which committee the testimony is being submitted, the date and time of the hearing, and the number of copies needed for submittal.  In addition, please provide the testifier's name and mailing address in the email.  Email sent to individual offices or any other Senate office will not be accepted.

 

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
