RELATING TO RANDOM DRUG TESTING. Requires random drug testing of public school employees, teachers, and public library employees; requires department of education to adopt rules to determine sanctions for positive drug tests. Establishes employee assistance program.

RELATING TO ELECTED OFFICIALS. Requires testing for illegal drugs of all elected officials of the State, county, board of education, and office of Hawaiian affairs. Disqualifies any person who tests positive for illegal drugs from taking office. Requires forfeiture of office upon testing positive for illegal drugs.

RELATING TO THE PROCUREMENT CODE. Provides a preference for qualified bids submitted for repair and maintenance services on the premises of public education facilities, if the project will provide students with experiential learning opportunities.

RELATING TO TEACHERS. Provides teachers receiving satisfactory service performance evaluations with annual step increases for five years. Denies DOE teachers with marginal service performance evaluations from receiving annual step increases. Excludes teachers at the top salary levels from receiving annual step increases.

SB 96 |
RELATING TO THE DEPARTMENT OF EDUCATION. Requires the department of education to develop procedures for obtaining the criminal history of persons who are seeking to serve as providers or subcontractors and trainees from an institution of higher education. Allows the department to pass on fees charged by the Hawaii criminal justice data center. Repeals the authority of the department to refuse to issue or to revoke a teaching or other educational certificate. Makes appropriation. |

RELATING TO EDUCATION. Provides funding to the University of Hawaii to design, research, and develop an interactive searchable web-base database.

RELATING TO CLAIMS AGAINST THE STATE. Makes an appropriation to the department of education to settle pending class action lawsuits brought by part-time and substitute teachers against the department of education of unpaid wages.

RELATING TO EDUCATION. Establishes a five-year pilot program within the department of education to provide trade pre-apprenticeship programs within public schools. Appropriates funds for the establishment of the pilot program.

Persons wishing to testify should submit 40 3-hole punched copies of their testimony to the committee clerk, Room 227, State Capitol, 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. In addition, testimony may be emailed to the Public Access room at testimony@capitol.hawaii.gov. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign language interpreter, wheelchair accessibility, or parking designated for the disabled), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
Public Folder. A folder labeled “Public Folder” containing the measures and testimonies for the hearing will be available for shared use by members of the public.
