RELATING TO GENERAL EXCISE TAX.

Provides a general excise tax exemption for income received from the State as a an operator of adult residential care homes types I & II; group child care home; group child care center; developmental disabilities domiciliary home; community care foster family home; & adult foster home.

RELATING TO HOUSING.

Exempts any eligible rental project that is dedicated to 100% affordable in perpetuity from the requirements of land use and environmental impact statement laws, and all county land use, charter, ordinance, and rule provisions.  Provides that if the eligible project is on public lands, the housing finance and development corporation shall lease the land at $1 per year.  Requires that if the land is ceded land then 20% of the units be made available to native Hawaiians.  Repealed 6/30/2010.

RELATING TO HOUSING.

Amends chapter 201H, HRS, housing development provisions to allow county councils to approve certain expedited government housing development projects with modifications, and to extend the county and Land Use Commission approval or disapproval window for these projects from 45 to 90 days.

RELATING TO INCOME TAX.

Assesses a graduated anti-speculation tax on the capital gains realized on real property held from less than 6 months and up to 24 months before sold.  Deposits realizations to rental housing trust fund.

RELATING TO FAMILY SELF-SUFFICIENCY.

Provides that the Department of Human Services shall not consider moneys in Escrow Accounts established under the federal Housing and Urban Development Family Self-Sufficiency Program when determining eligibility for assistance or other benefits under Chapter 346, Hawaii Revised Statutes.

RELATING TO THE STATE RENT SUPPLEMENT PROGRAM.

Broadens participation in the State Rent Supplement Program by removing the statutory limitation on the subsidy amount (currently $160 per month) and increasing the income limits for participation from 50% of area median income to 95% of area median income.

RELATING TO HOUSING.

Establishes a low interest loan program for persons who are at least 55 years of age who meet income and occupancy qualifications to repair their homes to comply with building, electrical, and plumbing codes.

Establishes a program for low interest loans and grants for home acquisition and rehabilitation for displaced or affected pineapple plantation workers caused by the closure of Del Monte Fresh Produce.  Establishes a rental assistance program for rental of safe, decent, and sanitary units for the displaced or affected workers in the private market.  Provides supportive services to prepare displaced or affected workers for homeownership.  Makes appropriations.

RELATING TO LOW-INCOME HOUSEHOLD RENTERS' TAX CREDIT.

Expands the qualifying annual income level for the low-income renters' tax credit from $30,000 to $40,000 per year.

Exempts affordable housing projects from the general excise tax and streamlines the review and approval of affordable housing projects.

RELATING TO CRIMINAL TRESPASS IN THE SECOND DEGREE.

Makes criminal trespass in the second degree applicable to public housing projects administered by the Hawaii Public Housing Authority.

RELATING TO INJURY PREVENTION.

Requires counties to adopt ordinances requiring the installation of window guards and locks located at the top of lanai doors in all dwelling units in which a child or children 10 years of age and under reside.

Requires landlords of condominium units to provide tenants with at least thirty days notice of construction.
