RELATING TO SOLID WASTE. Requires distributors to report container numbers sold and make fee payments on that basis. Permits calculation of redemption value by container count in certain instances. Allows refusal of refund for previously processed and baled containers. Permits the director of health to suspend the deposit beverage container fee. Requires dealers with more than 75,000 square feet of interior space to operate a redemption center.

RELATING TO TORTS. Limits non-economic damages in medical tort actions contingent on compliance with premium rate caps by insurers providing professional liability insurance in Hawaii. RELATING TO PRESCRIPTION DRUGS. Makes rebate agreements between drug manufacturers and department of human services mandatory. Requires the department to inform health care providers about drug costs for manufacturers with rebate agreements and those without rebate agreements.

RELATING TO THE STATE PHARMACY ASSISTANCE PROGRAM. Creates a Hawaii State Pharmacy Assistance program by merging the current State Pharmacy Assistance program which coordinates the Medicare Part D drug benefit and the Hawaii Rx plus program under a single comprehensive Hawaii State Pharmacy Assistance program umbrella.

Establishes a means under state law by which appropriately trained and supervised psychologists practicing at federally qualified health centers or clinics in medically underserved or a mental health professional shortage areas may prescribe a limited formulary of psychotropic medications. RELATING TO CHAPTER 460, HAWAII REVISED STATUTES, OSTEOPATHY. Makes the application requirements for doctors of osteopathy consistent with those for doctors of medicine. Clarifies the osteopathic residency program, and allows the Board to accept national osteopathic exams. Makes the requirements for a limited and temporary DO license consistent with that for a limited and temporary MD license.
