SB 2208

RELATING TO WAGES AND OTHER COMPENSATION.

Requires private employers who provide pension plans to their employees to allow an employee who has vested to receive pension payments upon becoming disabled, regardless of age. Applies to new employees hired after the effective date of the Act.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Provides for automatic post retirement allowance increases based upon the number of years of credited service and the number of years in retirement.

RELATING TO THE REHIRING OF RETIREES.

Enables public retirees to be rehired by the State or counties without suspension of their benefits.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Adds a definition of "child or children" to conform to administrative interpretation and includes in the definition: children living with an employees' retirement system member in a regular parent-child relationship for whom the member is the guardian or has legal and physical custody pursuant to a valid court order. Allows former contributory plan members and returning nonvested contributory plan members whose employees' retirement system accumulated contribution balances are $1,000 or more to leave their contributions in the system until they reach age 62.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Excludes from membership in the hybrid plan members of the employees' retirement system who received in-service refunds of pension contributions made under section 414 (h) (2) of the IRC. Repeals the provision for hardship withdrawal of employees' retirement system contributions.
