RELATING TO COUNTY LAND USE PLANNING.

Requires any chapter 201G housing project to conform to the general plan of the county in which the project is to be situated. Allows the legislative body of the county 75 days to approve or disapprove of a chapter 201G project. Allows counties to reclassify land areas of 50 acres or less, except conservation land.

RELATING TO PUBLIC PROPERTY.

Directs the attorney general and the department of land and natural resources to commence a special proceeding pursuant to section 101-52, Hawaii Revised Statutes, for the acquisition by the State of certain lands in Haiku, Oahu, Hawaii.

RELATING TO LAND EXCHANGE.

Directs the Department of Land and Natural Resources to enter into negotiations with the George Galbraith Estate for a land exchange of private agricultural lands situated north of Wahiawa, Oahu.

RELATING TO BED AND BREAKFAST HOMES.

Requires counties with a population of 500,000 or more to allow the operation of, and register bed and breakfast establishments that would not otherwise qualify for operation under county regulation; provided that the home is in existence as of 01/01/04; the home is registered with the county after 06/30/04, but before 10/01/04; and the owners of the homes acquire a GET license and a TAT certificate. The dedicated tax revenue would be used to assist the homeless.

RELATING TO BEACH RESTORATION AND PROTECTION.

Requires DLNR to adopt rules. Allows taxpayers whose state income tax refund for any taxable year is $2 or more to designate $1 of the same to be paid into the beach restoration special fund.

RELATING TO SUBMERGED LANDS.

Permits installation and maintenance of private residential noncommercial pier subject to state submerged land lease to be without lease rent; subject to administrative charge.

RELATING TO BOATING.

Limits the moorage fees based on a percentage of the gross revenues derived from the use of a commercial vessel to a maximum of 3% of gross revenues. Requires that certain fees relating to boating and established pursuant to rule be deposited in the boating special fund.

RELATING TO LAND CONSERVATION.

Establishes land conservation commission and land conservation trust fund. Requires one per cent of all state fund appropriations for capital improvements designated for the construction and renovation of state buildings to be deposited into the land conservation trust fund.

RELATING TO INJECTION WELLS.

Authorizes the department of health to disapprove the construction of any underground injection well or the disposal of any waste into an underground injection well if doing so will degrade the quality of coastal water.

RELATING TO COMMUNITY-BASED MARINE COMANAGEMENT.

Creates a framework for community-based marine comanagement. Authorizes the department of land and natural resources to designate community-based marine comanagement areas. Encourages the formation of community-based marine comanagement area councils and management plans. Provides for enforcement and penalties for violation of any rule or law applicable to any community-based marine comanagement area.
