Requires the governor or executive agency taking any action on transactions involving public lands that is subject to legislative disapproval, to provide reasonable and timely notice of that action to the legislature; allows legislative disapproval to be exercised in the legislative session in which an governor or executive agency action is taken. RELATING TO NORTH KOHALA.

Preserves a cluster of historical sites in North Kohala on the island of Hawaii by authorizing the department of land and natural resources to condemn the land adjacent to the Kohala historical sites state monument. Allows the Mo`okini Luakini Corporation to protect and care for the Mo`okini Heiau.

RELATING TO PUBLIC PROPERTY.

Instituting a misdemeanor penalty and fines for any person obstructing access to the sea, the shoreline, any inland recreational area, or any of the public rights-of-way, transit areas, or public transit corridors.

RELATING TO THE HAWAII HISTORIC PRESERVATION SPECIAL FUND.

Authorizes the deposit of penalties, fines, and other administrative charges into the Hawaii Historic Preservation Special Fund. Allows moneys from the fund to be used to pay for permanent and temporary staff positions, and administrative and operational costs for the historic preservation program. (SD1)

RELATING TO INTERIM RULES OF THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

Allows the Department of Land and Natural Resources to adopt interim rules to protect native species threatened with imminent extirpation or extinction. (SD1)

RELATING TO COASTAL ZONE MANAGEMENT.

Clarifies the definition of "shoreline" to mean the uppermost reach of the waves, other than storm and seismic waves during the season of the year in which the highest wash of the waves occurs, usually evidenced by the resultant debris line or the first stable vegetation, whichever is furthest mauka or inland; provided that the vegetation is not influenced or modified by human intervention. (PROPOSED HD1)

RELATING TO BOATING.

Caps mooring fees for a use permit at small boat harbors at 3% of gross revenues. Allows the department of land and natural resources to adopt rules covering fees and penalties. (SD1)

RELATING TO NATURAL RESOURCE VIOLATIONS.

Amends sections relating to the Department's enforcement authority within the Kahoolawe Island Reserve and for the protection of caves for consistency. Expands the Department's enforcement authority to all lands and waters of the State. (PROPOSED HD1)

RELATING TO THE FUNDING OF A HABITAT CONSERVATION PLAN.

Provide DLNR with the same financial flexibility afforded through federal guidelines regarding habitat conservation plans and exempting moneys generated by implementing or securing funding for habitat conservation plans from central services fees and administrative expenses. (SD1)
