RELATING TO UNADJUDICATED TRAFFIC FINES.

Transfers, in two phases, all fines and forfeitures collected for uncontested traffic infractions to the counties: 50% in fiscal year 2004-2005; and 100% after that date.

RELATING TO LICENSE RENEWAL.

Allows counties to impose an additional unspecified fee on individuals convicted of DUI when those individuals renew their license.

RELATING TO RACING ON HIGHWAYS.

Imposes stricter penalties on persons convicted of racing on highways at greater than thirty miles per hour over speed limit.

RELATING TO MOTOR VEHICLE DRIVER LICENSING.

Requires all drivers under age eighteen to be accompanied by a licensed driver over age twenty-one when driving between 10:00 p.m. and 4:00 a.m., subject to exceptions.

RELATING TO DRIVER LICENSING.

Establishes a 3-stage graduated driver licensing program for persons under the age of 18. Requires them to be accompanied by a licensed parent or guardian when driving between 10 p.m. and 4 a.m., with limited exceptions. Requires temporary instruction permit holders to be accompanied by a person who is at least 21, rather than 18, when driving.

RELATING TO THE TRAFFIC CODE.

Amends traffic code to increase pedestrian safety. Increases penalties for failure to comply with pedestrian safety laws.

RELATING TO TRANSPORTATION.

Mandates vehicle forfeiture if a person is convicted for street racing within five years of one or more prior convictions. Clarifies that forfeiture applies to vehicles used by the defendant in the commission of the offense.

Limits reimbursement from counties for audits of counties by state auditor to audits in which funding was appropriated by the legislature.

Requires insurers to notify police of cancellation and nonrenewal of policies.

MAKING AN APPROPRIATION TO THE AVIATION MUSEUM OF THE PACIFIC.

Appropriates matching funds of $1,000,000 for restoration and exhibits for an air museum for the Aviation Museum of the Pacific.

Appropriates funds to the Hawaii civil air patrol for operational expenses.

RELATING TO IMPACT FEES.

Restricts spending of impact fees for any developments other than the one which was assessed the impact fee.

RELATING TO INSURERS.

Requires reciprocal insurers that insure military members, veterans, and their dependents to make satisfactory arrangements for claims and policy servicing, but exempts them from the requirement to maintain a claims and sales office in the State.

MAKING AN APPROPRIATION FOR THE DEPARTMENT OF DEFENSE.

Appropriates money for the department of defense to publish the Hawaii veterans' newsletter.

RELATING TO THE EFFECT OF EMERGENCY MILITARY SERVICE ON ORDER OF CHILD SUPPORT.

Allows for military reservists called to active duty to have the director of the Child Support Enforcement Agency within the Attorney General's Office to modify their order of child support to reflect the change of their financial status.

RELATING TO LIQUOR LICENSES.

Requires a liquor licensee to submit to the public hearing process upon an application for expansion of their business premises.

RELATING TO HOUSING FINANCING PROGRAMS.

Removes limit on amount of bonds authorized to be issued if bonds are issued in connection with any program to provide housing for active or retired United States military personnel, their families and other persons authorized to reside in such housing.

RELATING TO THE MILITARY.

Allows active-duty reservists and National Guardsmen who desire to run for office to file nomination papers and take their oaths by mail.

RELATING TO TAXATION.

Increases the allowable income tax deduction for national guard members and reservists called up to active duty from $1,750 to $5,000.

Persons wishing to testify should submit 35 copies of their testimony to the committee clerk, Room 230, State Capitol, 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
