RELATING TO THE JUDICIARY.

Removes the expedited sentencing program's pilot project status by repealing the sunset date and the yearly reporting requirements.

RELATING TO ACT 316, SESSION LAWS OF HAWAII 1993, AS AMENDED BY ACT 157, SESSION LAWS OF HAWAII 1995.

Prevents inadvertent repeal of probation laws by adding reenactment language to laws that were amended by laws establishing the expedited sentencing program, and scheduled to "drop dead".

MAKING AN APPROPRIATION FOR THE DOMESTIC VIOLENCE WORKING GROUP.

Appropriates funds to continue the efforts of the domestic violence working group in examining the criminal justice response to domestic violence, identifying programs, and proposing, facilitating, and coordinating the implementation of effective solutions.

RELATING TO COURTS.

Requires judges who handle family law and domestic abuse cases to undergo education in subjects relevant to issues and problems unique to those cases; appropriates funds to implement the program.

Provides victims of domestic violence with the right to be notified by the defendant's probation officer when (1) the defendant violates any term or condition of probation; or (2) the probation officer has any information that relates to the safety and welfare of the victim.

RELATING TO DOMESTIC ABUSE PROTECTIVE ORDERS.

Authorizes dismissal without hearing of certain applications to modify terms of existing protective orders.

RELATING TO PROMOTING CHILD ABUSE.

Expands definition of the acts constituting promoting of child abuse in the first degree. Increases penalty for promoting of child abuse in the 2nd degree to a class B felony.

PROPOSING AMENDMENTS TO ARTICLE VII OF THE HAWAII CONSTITUTION REGARDING AN EMERGENCY AND BUDGET RESERVE FUND.

Proposes to establish a fund for emergency and budget reserve purposes and to clarify that appropriations to the Emergency and Budget Reserve Fund are excluded from the general fund expenditure ceiling and that appropriations from the Emergency and Budget Reserve Fund are included.

DECISION MAKING TO FOLLOW

Persons wishing to testify are requested to submit 35 copies of their testimony at least 24 hours prior to the hearing to: (1) the committee's vice chair in room 332, state capitol, or (2) the house sgt.-at-arms personnel in the turnaround area of the capitol basement parking lot. Testimony may be faxed to the house sgt.-at-arms office at: 586-6501 (oahu) or 1-800-535-3859 (neighbor islands). When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies that are needed for submittal.

It is also requested that the copies be on one side of an 8-1/2" x 11" sheet with two holes punched at the top. For further information, please call the JHA committee clerk at 586-8480.

Oral testimony shall be limited to 3 minutes.

If you require special assistance or auxiliary aids and/or services to participate in the public hearing process of the state house (i.e., sign language interpreter, wheelchair accessibility, or parking designated for the disabled), please contact the committee clerk at least 24 hours prior to the hearing so arrangements can be made.
