[§323C-34] Emergency circumstances. Any person who creates or receives protected health information under this chapter may use or disclose protected health information in emergency circumstances when the use or disclosure is necessary to protect the health or safety of the individual who is the subject of the information from serious, imminent harm. A disclosure made in the good faith belief that the use or disclosure was necessary to protect the health or safety of an individual from serious, imminent harm shall not be a violation of this chapter.
